The ground for appeal
On 22.1.19., I had
filed RTI application to the
PIO, office of BMC , Bhubaneswar seeking information about Expenditure towards advertisement by BMC. Though 30 days passed, the PIO did
not respond my RTI Application. On 3.2.19., I filed first appeal to the FAA to hear
my case and direct the PIO to
supply the information. On 12.4.19., the FAA heard the case
and directed the PIO to supply
the information within 15
days. But the PIOs
did not supply the
information.
So, I request the Commission to
hear my case , direct the PIOs
to supply the complete
information and impose highest penalty on PIOs
for violation of RTI Act even
despite order of the First Appellate Authority.

7. The ground for appeal
On
6.12.18., I had filed RTI application
to the PIO, Office of Odisha State Cooperative Bank
Bhubaneswar seeking information about Information
about gross salary, orderly allowances, yearly incentive, medical
reimbursement, etc paid to Tusar Kanti Panda Ex-MD, OSCB for the period
April’2017 - till date. On 5.1.19., the PIO has sent a letter denying to provide me information on the ground of section 8(1)(j) and section-11(1) of the RTI Act. In fact the ground taken by the PIO to deny information is baseless. On 11.1.19., I filed first appeal to the FAA putting
the following arguments for consideration in respect of supply of
information.
a. The required
information does not come under
section 8(1)(j) and section 11(1)
of the RTI Act.
b.The salary
and allowances of employees come under
suo moto disclosed category of
information under section 4
(1)(b)(x) of the RTI Act. That’s why the
office of Chief Minister and Odisha Information Commission has uploaded their
salary and allowances in their
respective websites. Many Departments have also uploaded the said information
in their websites.
c. medical
reimbursement bill and
incentives does not come under exempted category , as the money
is being paid from state exchequer
, paid by the citizens.
Adhering to law, the PIO , office of Odisha Legislative assembly has
provided details of
medical reimbursement taken by MLAs( Copy enclosed). Is T.K.Panda
is bigger than our MLAs . is OSCB is
bigger than Odisha Assembly . As
huge money has been
misappropriated, the PIO is denying to
disclose the information. RTI Act
in its preamble has empowered
citizens to fight out corruption .
This information must be disclosed
under RTI Act in the greater
interest of public.
The
FAA neither heard the case nor passed any order.
I request
the Commission to hear the case ,
direct the PIO to provide me the information
and impose penalty on PIO for
repeatedly denying the information.

denied to provide information on
the ground of 3rd party information.
On 17.1.19, I filed first appeal
to the First Appellate Authority citing
the following reason/ observation.
“As I
observe either PIO does not have knowledge
about what is
third party information or has he
/she deliberately with malafide
intention denied to provide information.
“Third Party
Information” is an information
provided by third party
in confidentiality . Here
neither any person has supplied
any information nor has asked public authority to maintain confidentiality of
the information supplied by him or her. Caste of a family or a person is decided by tahasildar who is empowered to issue
caste certificate to any person. Caste of a person is a
public information as every citizen has right
to know someone’s caste. A person also declares
publicly about his or her
caste , whenever any inquiry conducted
or asked for. Disclosure of
caste will also check forgery and manipulation in availing Govt.
benefits by someone. So
caste needs to be disclosed
in public interest to verify authenticity of caste
of someone to help the Govt. to give
benefit to right person.
Secondly, if
logic of PIO about caste as third party
information is taken into
account, the PIO should have
noticed to third parties seeking their
opinion whether the information will be disclosed under section 11(1)
of the RTI Act. But astonishingly, the PIO has not observed any
formality under the LAW. It
is clear that the PIO with malafide intention has denied
to provide the information and
having ill-intention to harass me which attracts penal
action under section 20(1) of the
RTI Act.”
The

disposed it any order.

did not pass any order.

On 28.12.18, I had submitted
RTI Application to the CPIO,
office of the Senior
Superintendent of post offices,
Bhubaneswar Division,
Bhubaneswar-751009 seeking copy
of all documents submitted
by Benudhar Behera working in Mukunda
Daspur BO under Pipili SO
at the time of joining.
The RTI Application was forwarded to the CPIO, office of
the Senior Superintendent of
post offices, Bhubaneswar Division, Bhubaneswar-751009 On 14.1.19, while responding my
application, the PIO has
rejected my application
on the ground of non-submission
of identity and address proof
as per rule 3 of RTI Act.
Then, on 7.2.19., I
made first appeal to the FAA to hear my case and direct the CPIO to provide information citing the
following arguments.
“ As In understand,
the CPIO is immature and very poor
in knowledge about RTI
Act or having
malafide intention not
to provide the
information. Under RTI Act, there is no such provision of production of identity
or address proof of information-seekers . As per
section 6(2) of the RTI Act, “an applicant making
request for information shall not be required to give any reasons for requesting the
information or any other
personal details except those that may
be necessary for
contacting him”. So
no address proof is
required under RTI Act. Section 3 of the Act
has not made any provision for production of address or identity proof. The Central RTI
Rules, 2012 has also not made
any provision for
production of identity or
address proof for the citizens. This is illegal
to force any citizen to submit proof of identity
or address.”
On 9.5.19.,
after 3 months since submission of First Appeal, the
FAA rejected appeal petition
by upholding order of CPIO.

RTI Application to the CPIO,

think the PIO is immature and

money. The citizen has right to know
about who takes their and purpose.
The information sought for is not
at all personal information. When
Odisha legislative assembly discloses
all information about details of
payment made against incentives and medical reimbursement of ministers
and MLAs under RTI, how the PIO
will deny to provide information about an officer.
Section 8(1) (j)
also states that “ provided
that the information which can
not be denied to the parliament or a
assembly shall not be denied to any person.”.
The PIO must clarify whether the said information will be shared
with state assembly, if it is sought
by hon’ble MLAs in the assembly.
I
also alleged that the PIO with malafide
intention had denied to provide
information and conceal
some irregularities committed by Bishnu pada sethy.
On 29.4.19., the FAA

I beg to state that on 9.2.19., I had sent RTI Application by speed post
to the PIO, Office
of sports and Youth
services, Govt. of Odisha seeking information about Hockey
World Cup. Though one month
passed, the PIO did not supply
any information. On 28.3.19., I
made first appeal to the FAA to hear my case and directed the PIO to
supply the information. On 17.4.19, the
FAA heard the case and directed the PIO to supply the information. But
the PIO did not supply any
information.
I request
the Commission to hear the case ,
direct the PIO to provide me the information
and impose penalty on PIO for
repeatedly denying the information.

beg to state that on 9.2.19., I had sent RTI Application by speed post
to the PIO, Office
of sports and Youth
services, Govt. of Odisha seeking information about Hockey
World Cup. Though one month

impression that the PIO
has willfully kept the
information secret. This is
blatant violation of RTI Act. If
the information is not available, the PIO should have forwarded
RTI Application to another
public authority for
supply of information.

On 8.1.19., I
filed RTI Application to the
PIO seeking information about fund sanctioned for World Hockey Cup. On 5.2.19., the PIO
intimated me to visit website
www.sportsodisha.gov.in to get
the information. I visited the
website but found
the information incomplete.
I have asked the PIO to provide
me hard copy of the information. The PIO has not done. Then I made first appeal
requesting FAA
to enquire into
details of it by visiting
website and comparing it with the
information sought for and direct the
PIO to
supply the required information
in hard copy free of cost. The FAA
fixed date 23.3.19 for hearing of the case but did not send me copy of the order.
I request the
Commission to hear the case , direct the
PIO to provide me the information
and impose penalty on PIO for
repeatedly denying the
information.
