Memorandum submitted to Governor, Odisha on Dankari Mining loot by BJD Govt.

Sub- Seeking legal Action against  Mining Mafia, local MLA , BJD leaders   and Govt. officials  involved in loot of Black-stone  in Dankari Hill  under Dharmashala Block  of Jajpur  district  causing  Rs. 10,000 crore   revenue loss  and recovery  of the same- Regarding  .

Esteemed Sir

We, the  members  of Civil society Groups  along  with Dr. Damodar Rout, former Minister , Govt. of Odisha  on fact-finding mission had visited Dankari  Hill on 18.2.19 for  physical  inspection and assessment  of magnitude  of exploitation of minor  minerals  i.e., black-stone   in the Hill in the backdrop  of NGT Order in complaint petition No. 604/2018  filed  by Sarbeswar Behura , RTI  Activist   and Member  of Odisha  soochana adhikar Abhijan. The gist of the order of NGT dated 4.1.19. NGT has  directed to initiate appropriate  departmental action  for the misconduct  of the officers  involved  in permitting illegal   black stone quarrying  as found  by the inspection committee  constituted  by NGT. Apart  from  such disciplinary  action, the state  has to recover  the cost of illegally  mined material, cost of damage  to environment , Net present Value  of ecological services  foregone  as well as  cost of restoration  of the environment.

As  reported  by media, Dankari Hill forest  area , storehouse  of blackstone mines  comes  under  jurisdiction  of Dharmashala Tahsil  of Jajpur  district, Odisha.  This area, habitation of 700  population  of Dankari village  under Mahisara Gram Panchayat   is 15 kms   away  from Dharmashala Tahsil. Sribasa  Jena ,  a former  Zilla Parishad of Biju Janata Dal,  rulling party , highly  politically  influential  person  closely  connected  to local MLA  and  state  power corridor  undertook   illegal  mining  operation I,e,  extraction of  black stone mines  in Dankari Hill  with  complete   support  from district administration  in 2002. He carried out wagon  drill for   black stone mining quarry which caused  huge  water  and environment  pollution  in the locality.

During our  visit to the  spot located  around 22 kms  from Dharmashala , a big Hill  top ,  we  observed  huge  mining extraction operation  in  various  places  of Dankari Hill and a number  of crushers in operation  around the  hill. On query  about  mineral  exploitation, the  villagers  of Dankari  and Dharmashala  appraised  us  about illegal  mining  exploitation by  mining  mafias  which  is going on since  15 years. Sabitri Sahu, leading  woman activist  who  had been to jail   for 22 days  due to her  opposition to  illegal mining  operation  by mining mafias said  that  Mining Mafias   in collusion with  Sri  Pranab Balabantaray, local MLA, BJD leaders  and Govt. officials   have undertaken illegal mining operation  and  looted  crores  of rupees at the  cost of state  exchequer.    The huge  mining  operation  without  environment  clearance from Odisha State  Pollution Control Board  has caused  serious  health  and environment  hazard  in the area  and greatly affected  the locals. Most  of the  people  are  seen  suffering  from various  disease  like cardiac arrest, kidney  damage, liver  problem etc.    Around 40  people  have  died   due  to lack of proper  treatment  in the  locality.

 The  team  also observed that  the whole  Govt. machinery  with tacit  support  from office of Chief Minister   have  extended  their  support b to mining  mafia  to extract  minerals  from the Hill.  It is also apprehended   that  the black money generated  from mining extraction  has been used  for  party  activities  of BJD  and their  election management .  The  involvement of the  office of Chief Minister , Odisha  can not be ruled  out.

On 4.7.16., Sri Abhaya Nayak, Joint  Secretary, R & DM  wrote a letter  to  the Collector, Jajpur   to file FIR  for the theft  of black stone  to  the extent excess  than  the allotted quantity and   initiate  disciplinary  proceedings against the concerned R.I.s  and recommend  with memo of evidence  for drawal of proceedings  against Tahasildars  and other  higher  authorities. On  6.8.16., the ADM  submitted  to Revenue  and Disaster  Management  the  draft proceedings  against the 10 erring  Tahasildars  of Dharmashala in connection with  the illegal extraction  of Black stone  from Dankari  Black stone quarry  and loss of revenue  incurred during their  incumbency  as Tahasildars.   The   Tahasildars   were  directed  to submit their written statement of defence  within 30 days  from the date  of receipt of memorandum  and also to state  if they  desire  to be heard  in person. Similarly,  on 11.8.16,  the ADM  submitted  to Revenue  and Disaster  Management  the  draft proceedings  against the 6  erring  Sub-Collectors    in connection with  the illegal extraction  of Black stone  from Dankari  Black stone quarry  and loss of revenue  incurred during their  incumbency  as Sub-Collectors.   The    Sub-Collectors were  directed  to submit their written statement of defence  within 30 days  from the date  of receipt of memorandum  and also to state  if they  desire  to be heard  in person.

Though notice  for  disciplinary  proceedings  was  issued  to  10 Revenue Inspectors, 10 Tahasildars  and 6  Sub-Collectors,    it  was kept  pending for  years together. No action was  taken against  erring  officials  till yet. These  officials  were protected  by the State  Government, political  leaders , local MLA  and  others.

  So, we  request  His excellency to  direct  the state  Govt.  to initiate  action  against  the Mining  Mafias, Local MLA  and Govt. official  for exploitation  of  minerals  in Dankari Hill  and  recover   all  money   looted  by them.

( Exposed  under RTI)

RTI Application was  filed  to all Departments , Govt. of Odisha  seeking  information about  officers  and employees  serving more  than 3 years. As  per Govt. Rules   which has been amended  from time to time (P & S . Deptt. No. 9165/Gen., Dt. 28.4.1967, G.A. Deptt. No. 27789/Gen., Dt. 1.7.1992,) Officers  who have completed  more than 3 yaers  should be transferred . As  per  RTI  information obtained  from  various Departments  and subordinate  offices,  hundreds  of officers  are  serving more than 3 years, 6 years and 10 years  in same post  by way  of exerting political pressure or  influencing superior  officers  or  bringing stay  order  from the court.  It  has  damaged  working environment  and caused  great  dissatisfaction  among the  officers  who are  in same  particular location for  a longer period. I am present herewith  the  number of IAS officers  serving  in a particular post  for several years.  The OAS officers , Ministerial  officers and employees  serving  more than 3 years  will be presented later on.

Nobody knows about number of tribal Children in KISS


Nobody knows about number of tribal Children in KISS, Odisha

  •      None but only  Achyut Samant, founder  of KISS ( Kalinga Institute  of Social Science)  and BJD MP  claims  of  30,000 tribal children  studying in KISS  tribal  school.
  • Govt. of Odisha , forget public,    is not aware  about  number  of  tribal  children   staying  and reading  in KISS  tribal School, Bhubaneswar
  •   No Govt. Department  is aware  about  number of tribal students  of KISS school. 
  •  Authority  of KISS  has  not  shared  any  information  about number  of children reading  in tribal  school.
  •   OSCPCR and Child Welfare Committee, the monitoring statutory bodies are not aware about it.
  •  District Welfare Officer, a designated monitoring officer for tribal schools is also not aware  about  it.
·         It is astonishing that how such a reputed institution maintains utmost secrecy  about genuineness  of the number  of tribal children reading in the school.

Dear friends

KISS ( Kalinga Institute  of Social Science) , an NGO running  tribal  school in Patia, Bhubaneswar which  is founded  by Achyut Samant ,  BJD MP and a front-ranking  land grabber  in the state .  He  has given  public statement  several times  that  total  number  of 30,000  children  are  housed  in KISS tribal  school. They are  provided  free lodging, fooding, shelter  and education  in the KISS campus. To  verify  the authenticity  of information about  exact number of tribal  children reading in the  school, RTI Application  was  submitted  to the PIO, Office of Secretary, KISS  to  provide  details of  information  about  number  of children  reading  in the school. The Authority  of KISS  refused  to divulge  any  information, as  they  do not  come  under RTI Act. Now  the matter  is  for  consideration  in the  court of Odisha Information Commission.
However,  to get  the information from Govt. sources , on 4.1.19, I had filed  three  RTI Applications to the PIOs of Department of   Women and Child Development,  Department  of School  and Mass Education  and Department of SC and ST Welfare, Govt. of Odisha   seeking  information about  number of children reading  in KISS Tribal school.

On 11.1.19, the PIO, Department of  School  and Mass Education  forwarded  my RTI Application  to the PIO, Department of  SC and ST Welfare  to provide  information to provide information, as it is  not  available with them.

The PIO, Department  of  Women  and Child development  forwarded   RTI Application to the PIO, Department of SC and ST welfare to provide  the information. Clubbing together all RTI Applications, the PIO, Department of SC and ST welfare  forwarded  the RTI Applications to District   welfare Office ( DWO), Khurda  to  provide information.  Astonishingly,  the said information is not  available  with with DWO, Khurda.    On 1.2.19, the PIO, office of DWO, Khurda has transferred my application to the KISS, Bhubaneswar  which never  divulges  any information to anybody.

Why the  Departments  should keep the  information ?
 As  per  the  Right to education Act,  the  School  and Mass  Education  Department  is the  nodal department  for sanctioning  NOC  and issuing certificate  of registration  to the private schools  every year.   Block Education Officers have been designated by Govt. of Odisha  to monitor  these private schools. Astonishingly, BEO, Khurda  has never  visited  KISS Tribal  school and has not  gathered  any  information  about   number  of the  tribal children staying  there  for  which  the  information is not  available  with the School  and Mass education department.

As per  provision of  Juvenile Justice  Act, the NGOs  housing children and running  child  care  institutions  should  be registered  with  the  Govt. i.e., Department  of SC and ST Welfare  and District Welfare  officer.  The  District  Collector  is the  monitoring  authority  to  monitor  and inspect  the Child  Care  Institutions.  But  the District  Collector of Khurda  has never  visited  KISS to inspect  the same.    

As    DWO, Khurda  is the  monitoring authority  of  all  tribal  schools, the DWO must  have access  to  the  said information. So  the DWO  need not  transfer RTI Application.   Rather  the DWO, as monitoring  authority   should   collect  the said  information  from KISS  and provide  to me  as per section 2 (f)  of the RTI Act without  forwarding same under  section 6(3) of the RTI Act. 

Nexus  of  State  administration and  KISS  authority  is quite  guessed  for  which  no Govt. officer  ever visits  the  school  to discharge  their  function as monitoring  authority  under RTE Act  and JJ Act.

This  is horrible  state  of afafirs  of Nabin Patnaik Govt.  in Odisha which claims a transparent  Government  without any transparency .
