Odisha Human Rights Commission and State Information Commission  directed  to Inspector General of Police, Central Range, Cuttack   for enquiry into allegation made  by Bhakti Ranjan Palai, RTI Activist  about  false  and fabricated case registered  against him by Inspector In-charge, Krustanprasad Police Station,  Puri illegal arrest, misbehavior, merciless beaten up during arrest in the office of SP, Puri

On complaint filed  by Bhakti Charan Palai, RTI Activist and Member of Odisha Soochana Adhikar Abhijan under  section 18 of the RTI Act, Odisha Information Commission immediately registering  the case Complaint Case No. 692/2018 dt.2.5.18  issued  notice to  Inspector In-charge, Krustanprasad Police station AND SP, Puri  seeking report  about allegation of  false case  filed  by police  against Sri Palai and harassing  him  for  use of RTI extensively  to expose  corruption in Block office and Police station. 

Similarly, acting on complaint filed by Sri Palai, Odisha Human Rights Commission registered the case No. 1747/18 dt.11.5.18 and directed Inspector General of Police, Central Range, Cuttack for inquiry into the matter and submit the report within one month.

Sri Bhakti Palai has alleged that he was informed by his family members and friends about a cases registered   against him in Krustanprasad police station on 24.1.18. In the FIR filed by Golakh Bihari Rout, Sub-Inspector of Krustanprasad Police station that under his leadership, 1000 supporters entered into Krustanprasad police station  and created ruckus inside police station, ransacked various  important assets and damaged other valuable assets etc. Another FIR was also lodged against me to attempt rape a lady police constable in the police station.

In fact on that day, he was  not present  in the area  and no way involved in mobilizing  the people  to ransack  the police station of Krustanprasad.  He was in Bhubaneswar and taking his class in  the Tutorial.

Registering this false FIR, the police started investigation and tried to arrest him. On dated 3.2.2018 midnight, around 20 police entered his home to search him. They broke down doors of our house and home appliances worth lakhs of rupees. They used insalubrious and filthy language to his mother, misbehaved her and threatened his old father to kill him. Due to this midnight operation by police and being mentally shocked by police torture, his parents are suffering from mental trauma and  their health condition deteriorating.

He has further alleged  that  as he has  been  filling  number of RTI Applications  to the office of BDO, Tahasildar  and Krustanprasad police station  in his  effort  to expose  corruption, illegalities and irregularities in implementation of Govt. scheme and programme,   the administration, police and political touts  joined hand together   to defame , denigrade and harass him. So that  he would refrain from filling RTI Applications. The police implicating him  in false case  and masterminded  to lodge FIR  is  the result of  administrative conspiracy  to disturb and discourage him  and put him  in trouble.   

While  Bhakti  had been  to Office of SP, Puri  on 10.4.18 to attend  hearing of first appeal  filed to SP under section 19 (1) of the RTI Act against denial of information by the PIO-cum-IIC, Krustanprasad Police station,   Dillip Swain, IIC, Krustanprasad police station reached in the office of SP, Puri and identified him sitting there.  Having seen him, he started to talk with him  in high tone and told him about pending warrant case against him.  He strongly reacted and objected it. Then, he met SP and discussed with him. After being come out, he called his co-police officers to arrest him  and started abusing him  with slang language (HAIRE SHALA BESI PHUTANI MARUCHHU, CHORA SALA etc.).  he along with 4 police officers started beating him  and ousted  him from SP office and carried him  to Town police station. On that day, the police arrested him  and forwarded him  to jail.   They also took away my files, RTI Application, appeal petition, my mobile and purse containing Rs. 5000.00.   The SP, Puri is quite aware  about  this incident and  encouraged  the IIC, Krustanparasad  to arrest him against who I had field first appeal petition. The FAA neither heard the case nor disposed it.  He spent 12 days in jail and got released on 24.4.18.

OSCPCR issued Notice to Authority of KISS, Bhubaneswar on Missing of Tribal child

OSCPCR issued Notice to Authority of KISS, Bhubaneswar, SDPO, DCPO of  Malkangiri  to submit  report on Missing  of Bonda Tribal  boy from KISS Tribal School by 30.5.18

 On 8.5.18,  taking  cognizance  of complaint  case filed  by Pradip Pradhan, Human Rights Activist, Odisha State Commission for Protection of Child Rights ( OSCPCR), Bhubaneswar  has issued  notice  to Authority of KISS Tribal School, District Child Protection Officer, Malkangiri, Superintendent of Police, SDPO and Inspector-in-Charge, Pokhariput Police station, Malkanagiri  seeking  detailed report individually by 30.5.18  on Missing of Bonda tribal  Boy  who was  studying in KISS Tribal School  of Achyut Samant, newly elected  Rajya Sabha MP of Biju Janata Dal.

On 7.5.18, Sri Pradip Pradhan   filed complaint to OSCPCR seeking an inquiry into missing of a Bonda tribal child from KISS Tribal School, Bhubaneswar. Bonda Tribal boy named Rama Chandra was studying in class- VIII and got missing since 3 years. Having been influenced by agents of KISS Tribal School with assurance of free education and hostel facility, his mother has sent Ramachandra   to KISS tribal school, Bhubaneswar with great hope of educating   and nourishing him as meritorious student.  Having failed to find out her son, she  has   filed  an FIR in Pokhariput Police station, Malkangiri district  seeking an inquiry  into missing of her son and  find out his whereabouts. Sri Pradhan has alleged   that KISS Authority  has neglected  and not taken care of  Rama Chandra properly for which he is missing. Trafficking of Rama Chandra also can not be ruled out. KISS as institution is illegal, as it has not been registered  under Juvenile Justice Act, 2015.

In case of WPCRL 102 of 2007 the Hon’ble Supreme Court has already directed that “The Union Government and the governments of the States and Union Territories must ensure that the process of registration of all child care institutions is completed positively by 31st December, 2017 with the entire data being confirmed and validated. The information should be available with all the concerned officials. The registration process should also include a data base of all children in need of care and protection which should be updated every month. While maintaining the database, issues of confidentiality and privacy must be kept in mind by the concerned authorities”.

It is needled  to mention here that Bonda tribe, a most vulnerable  and marginalized Primitive Tribal Group  is residing  in  small patch of Bonda Hill of Malkangiri district, most underdeveloped  and naxal-affected district of Odisha.  Bonda tribes  are   still primitive  in  nature  and deprived section of society and survive in abject poverty , hunger and malnutrition. Most of them are illiterate and deprived  of school education. The State  Govt. is  undertaking a  lot  of  special project  including  Bonda  Development  Authority  for  upliftment  of Bonda tribes.

40,000 crore crop loan disbursed to farmers in Odisha within last five years

RTI Application was filed to the PIO, Department of Cooperation, Govt. of Odisha seeking information about total crop loan disbursed to farmers in Odisha from 2009-10 to 2015-16. My RTI Application was forwarded to the PIO, office of Registrar, Cooperative Societies, Odisha Bhubaneswar to provide the information. On 13.4.18, the PIO has provided the   information about  disbursement of crop loan from 2014-15 to 2017-18.

Comments

1.          Every year, around 15 to 16 lakh farmers are provided crop loan during  each kharif and Rabi season in the state .

2.         During last five years, the Govt. has provided Rs. 40,000 crore loan to around 1.5 crore   farmers in the state.

3.         A impact  study    should be done how such  a big amount of crop loan benefited  farming  community in Odisha

4.         A study should be undertaken   whether this huge amount has reached  to the farmers  or misappropriated  and looted by  the people  in name of farmers , officials  and political touts.

How information sought under RTI is cunningly denied by PIO of Odisha State Cooperative Bank to cover up mega corruption in the Bank

On 21.3.18 while responding UDA Q No. 45 in Odisha Legislative assembly, Sri Surya Narayan Patro, Minister for Cooperation said that the Government  had given order for inquiry  into alleged huge corruption and irregularities in Odisha State Cooperative Bank  by  a committee headed by Auditor General-cum-additional secretary of the office of Registrar, Cooperatives.

 Keeping it in view, the following information was sought under RTI dated 23.3.18 from the Department of Cooperation, Govt. of Odisha , Secretariat, Bhubaneswar.

1.       Copy of the decision taken by the Government in respect of constitution of the inquiry Committee headed by   Auditor General and copy of the enquiry report submitted to Govt.

2.       Copy of the  decision taken  in respect of  filling  of defamation case  in   the court of Civil Judge, Bhubaneswar  by  Odisha State Cooperative Bank against  two persons for making false allegation (?) of corruption and irregularities  in the Bank . It needs to be mentioned here that since last three years, a number of complaints has been filed by a number of Social Activists seeking an inquiry  into corruption and irregularities in the Bank.  Two vigilance case has also been filed against OSCB  seeking inquiry  into it. But the vigilance has not conducted any inquiry into it , as the  big people are  involved in it.  This is a 500 crore scam in Odisha.

3.       Copy of the inquiry report  submitted  by a committee of  two deputy secretaries of Cooperation Department and Joint-Register  of  Directorate of  Cooperation  into alleged  corruption in computerisation of  Primary Agriculture Cooperative Societies.( PACS) in Odisha

4.       On 30.6.17, the State Government in its letter no. 10489 has appointed Deputy-Register  and Assistant- Register of of  Directorate of Cooperation to enquire  into number of allegations of corruption  in Odisha State Cooperative Bank.   Provide copy of the report submitted, if any  to Government.

My RTI Application was forwarded  to the PIO, office of Registrar, Cooperatives  and  PIO, office of Odisha State Cooperative Bank on 17.4.18.

The PIO, office of Register, Cooperatives has not supplied  any information.  But  the  PIO, OSCB has  made useless and ridiculous  response and with malafide intention has denied the information to keep the information secret.

Missing of tribal child of KISS Tribal School case filed in CWC, Khurda , Odisha

Complaint case filed in Child Welfare Committee, Khurda  seeking inquiry into trafficking,  illegal confinement and abduction of tribal children by  KISS Tribal School, Bhubaneswar, Odisha

On 2.5.18, Dr. Subas Mohapatra  has filed  a complaint petition to Chairman, Child Welfare Committee, Khurda { a statutory  body constituted under juvenile Justice ( care and protection of children)  Act, 2015 } seeking an inquiry into the trafficking, abduction and Illegal confinement of Schedule Caste and Scheduled Tribe   Children by Kalinga Institute of Social Sciences, Bhubaneswar and to seal down the said non-registered organization under JJA- 2015   and to rescue and rehabilitation of Schedule Caste and Scheduled Tribe Children from the custody of  KISS Authority which is under   jurisdiction of CWC, Khurda.

 Dr. Mohapatra has alleged that  KISS Authority under control of Achyut Samant, newly elected  Rajya Sabha MP  of Biju Janata Dal ( BJD)  having criminal conspiracy with ulterior motief is engaged in trafficking, kidnapping and illegally confining the minor boys and girls from scheduled tribes communities from all across the State of Odisha and keeping all the juveniles, both need and care and conflict with law, further illegally confining them under a name and style of Kalinga Institute of Social Sciences without valid registration of JJA 2015. He has further alleged that  the authority in association with other law enforcing bodies are engaged in running a child- sex and kidney transplantation racket under disguise of social service organization. One Ramachandra Mandra, s/o. Mangalu Mandra of Mudulipada Police Station in Malkangiri District has been told to be missing, but the realities are mysteriously unknown to the concerned authorities who are duty bound to know and take legal action.

Election of Achyut Samant as Rajya Sabha Member was challenged in Odisha High Court

Subas Mohapatra filed election petition in Odisha High Court challenging election of Achyut Samant as Member of Rajya Sabha

Dr. Subas Mohapatra, RTI Activist filed election petition no. 1/2018 dt. 30.4.18 challenging election of Achyut Samant  as Rajya Sabha Member by members of Odisha Legislative Assembly. In his petition, Dr. Mohapatra has stated that  Achyuta Samanta filed his affidavit along with nomination paper before the Retuning Officer for election to Rajya Sabha from Odisha Constituency being a candidate set up by BijuJanata Dal  and he has stated on oath that his name is enrolled in Bhubaneswar North (Uttar) Assembly Constituency at Sl. No. 1263 in Part No.64.  Sri Samant  in Point No.5 of the Affidavit that was filed in Form-26 under Rule-4 A of the Conduct of Elections Rules, 1961  has consciously and categorically stated that he has not been accused of any offence(s). Sri Samant in answering to the queries made in Point No.5 (i) of the Form-26, specifically mentioned “not applicable” in respect of the details of queries such as Case(s)/ First Information Report No (s) together with compete details of concerned police station/ District/ State. Sections of the concerned acts and short description of the offences for which charged, Name of the Court, case No. and date of order taking cognizance. Sri Samant has also declared that the contents/descriptions of his  affidavit filed in Form-26  are true and correct to the best of his knowledge and belief and no part of the said affidavit is false and nothing material has been concealed there from  and   there is no case of conviction or pending case against him other than those mentioned in items 5 and 6 of Part-A and B of the said affidavit.

But Dr. Subas Mohapatra has alleged    that Sri Samant has miserably failed to submit true and correct information as required under the law to satisfy the bonafide of the acceptance of his nomination in accordance with law. He alleged that Sri Achyuta Samant  was  having more than one Voter I.D. Cards, thereby committing offence under Sections 17 and 18 read with Section 31 of the Representation of the Peoples Act, 1950. He  has consciously and deliberately misled to all concerned with the electoral process, thereby making false declaration about his date of birth, which is quite contradictory in his own documents filed with the various authorities from time to time. He has categorically mentioned that his total income in the Income Tax Return in respect of the Financial Year 2017-18, which in fact admittedly had not seen the light of the day, as the Financial Year 2017-18 comes to an end on 31st March, 2018, but the said affidavit   was filed undisputedly on 08.03.2018. Sri Samant  has also  miserably failed to provide true and correct information about his details of immovable properties/assets and floating (movable) assets including investments, bonds, debentures, shares and units in companies and mutual funds and other institutions, so also details of investments in other financial and non-financial organizations, thereby suppressing vital facts which affects the result materially.

 Sri Samant  has also suppressed  some information about  FIR No.114 of 2017 of Gadisagoda Police Station in the district of Puri in the State of Odisha,  filed  against him corresponding to G.R. Case No. 2369 of 2017, pending in the Court of Learned S.D.J.M., Puri, for the offences under Sections 341/ 323/ 294/ 452/ 354/ 506/ 120-B/ 34 of the Indian Penal Code, readwith Section 25 and 27 of the Arms Act.   Some  other cases are though pending against him   , but the details of the said crime have been consciously and out rightly did not find place in the affidavit filed by him at the time of filing of his nomination to be elected as a Member of Parliament.

Dr. Mohapatra has prayed  hon’ble High Court   to disquality  Sri Achyut Samant  as Member of  Rajya Sabha who  has defrauded  Indian Constitution by filling false affidavit.
