Fact-finding Report on Infant Deaths in Sardar Ballav Bhai Patel P.G. Institute of Paediatric (Sishu Bhawan), Cuttack of Odisha

Having gone through the repeated news about series of child deaths since few days in Sardar Ballav Bhai Patel Paediatric Hospital (Sishu Bhawan), Cuttack, the premier Institute in the state, the Civil Society Groups felt concerned about  the incident and decided to visit the Hospital on fact-finding mission  to ascertain the fact and factors responsible for such deplorable incident of huge child causalities in old hospital of the state. The eminent members of Civil Society Groups who visited the Hospital were as follows.

It is needless to mention here that   this paediatric Hospital is recognised as one of the best Child Care and Research Hospital in Eastern India. The 416-bedded   Hospital has only 21 ICU (Intensive Care Unit). The parents from different districts and other states like Jharkhand carry their children to this hospital with hope to get best treatment for their infants in every day. Since few years, there is wild allegation by the common people and patients about negligence of the doctors and the staff of the hospital in respect of treatment to the patients i.e., infants. It is reported that due to negligence of Medical staff, corruption, poor infrastructure, mismanagement, the death toll of the patients is rising every year.  Within four days, 29 infant deaths were reported by Hospital authorities. Details of the Visit of the Team
On 25. 8.15, the Team reached at Hospital at around 11.30. The campus was crowded with the presence of representative of Political parties and electronics media.  After reaching the   campus, the team members rushed to the Wards and ICU of the hospital to see the condition of the children admitted for treatment and inspect the surroundings of the hospital.  During interaction with ICU staff, Smt. Sanjukta Mishra, ICU In-charge appraised the team about number of the problems.  There is only 30 Nursing Staff against requirement of 70 staff in ICU for 3-shift duty in a day. As per medical norm, there should be one attendant per each patient in ICU.  Similarly, there is huge shortage of doctor in the hospital.  The Hospital is generally managed by PG Students.  The treatment of patients is also affected due to shortage in supply of syringe, gloves and   supply of medicine to the hospitals.   She   also shared three circulars with the Team  which is one of the reasons for damaging health system   and making health service costly  and depriving the poor people to access  the health service in ICU of the  hospital.

A.  Circular No-1: The office order dated 21.9.10 issued by the Superintendent of the Hospital mentions that  the bed charges  of ICU and Ventilator charges  will be  collected  from the patients  as mentioned below.
1. Bed Charges for first 5 days @ Rs. 250/- per day and 6th day onwards @ Rs.500/- per day.
2.     entilator charges will be collected @ Rs. 500/- per day.

B.   Circular No.-2 -  The office order ( No. 1244/SVPPGIP,CTC dated 10.4.15 ) issued  by the  Superintendent  indicates  that  the charges  for ABG with Electrolyte, Glucose  and Lactate  will be from Rs. 350/- to Rs. 400/-. The Charges with Electrolyte (chemical method) will remain same Rs. 200/- per test.

C.   Circular No.-3 -  There is instruction  by the Superintendent  in his office order dated 14.7.15  that the dues for 3 ( three days)  in advance  from the parents  during admission  in I.C.U.  will be  collected  and the Sister-in-Charge  will  collect the dues  on day to day  basis.

The above-mentioned fees charged by the Hospitals   have made the treatment very costly and unbearable on the part of poor patients. The Team members also visited the ICUs and General Wards and found the condition of the most of the infants critical and did not notice any vacant bed in the hospital.  The Sister-in-Charge also reported that there are around 15 patients in queue to be admitted   in the ICU.

Then, the Team members  interviewed  the parents of patients  asking few questions   about their  native place, reason for admitting their children in hospital, level of their satisfaction on treatment made by the doctors.  The response of the parents of the patients is as follows.

She has admitted her 3 day old baby in hospital.  The reason is the new born baby is having respiratory  problem.  As she   does not faith on CHC, she brought her baby to Sishu Bhawan for treatment.  The Treatment is groining on since 4 days. The condition of her baby  is still critical.

He carried her child to admit in Rourkela Hospital.  Having not been satisfied with the treatment, he got her baby  admitted in Keonjhar  District Hospital. Then, the Doctor referred  to Sishu Bhawan.   Every day, he is purchasing medicine of  Rs. 1200/-  to Rs. 1800/-  for treatment of her  child.

She had admitted her  6 month old baby  in Hospital  since 22 days. Every day, she spends Rs. 2500/- towards the cost of treatment. She has already spent Rs. 40,000.00  till now with no result.

The Team members experienced deplorable   and pathetic condition of the parents who have come to this hospital from far way area with the hope to get proper treatment for their children. But their hope has been dashed out due to serious negligence of the medical staff and demand of huge expenditure, fees charged by the medical etc. 

Meeting with Superintendent and Medical Staff
The Team tried to meet Dr. Niranjan Mohanty , Superintendent of Sishu Bhawan but  found absence. It was informed that he had gone to attend high-level meeting called by the Minister for Health and Family Welfare   to review the incident of infant death in the hospital. Then, the Team members met Manager of the Hospital and discussed about reason of the huge child causalities. He  said that  most of the cases  and the  children getting admitted in hospital  are referred by  the  district  hospitals  from different areas. These babies are admitted with critical condition. So the chances of survival   always remain doubtful. He preferred to remain silence on other critical issues raised by the Team.

Experience of the Team with a BPL Patient and story of his harassment by Medical staff
The Team members came across a BPL Patient loitering in verandah of the Hospital and demanding return of the fees charged from his, though he is BPL hard holder.  On query, it  was  found that   he is  a man from  Jajpur  who had come with 3 years baby  for treatment.  He met the doctor at outdoor and the Doctor    wrote the prescription and advised him to go for different test by depositing fees at counter.  He went to Medial counter to get the blood tested. But the staff sitting at the counter demanded   the payment of the fees. When he showed his BPL Card and demanded his entitlement of free treatment,   the staff abused him and asked him either pay money or leave the place. After   exchange of arguments and counter-arguments for few minutes,   he was forced to pay the amount of Rs. 190/- and got money receipt.  Having heard the story, one of the Team members carried him to the   staff claimed to be person hearing grievances.  After hearing the grievances, he said that the outdoor BPL patients were required to pay the fees unless they are admitted in hospital.  It was found that the people who are covered under Rastriya Swasthya Bima Yojana, Biju Krushak Kalyan Yojana are also entitled to get free treatment.  But the doctors are not aware about this provision for which the eligible patients could not get free treatment.  Though the BPL patient demanded return of the money, he was denied.  This the test case  and brings to limelight  how the BPL people are  getting harassed  ad denied  free treatment despite  production of   proof of the documents.

Critical Issues ad Recommendations
1.  This Sishu Bhawan is one of the prestigious premier paediatric hospitals for treatment of the infants in eastern India.  This Institute has gained reputation because of huge infrastructure, well-equipped staff and trained doctors, nursing staff.   The patients from different parts of Odisha and neighbouring states also come to this hospital with the hope to get better treatment of their children.   But in due course of time, this Institute has lost its credibility and respectability due to maladministration, mismanagement, corruption, lack of fund, apathetic attitude of the state administration   and disgruntled and corrupt staff of the Hospital.  The reason of the preset death of infants   cited by the authority is that most of the patients are admitted in hospital on referral basis. It means, many patients are referred to this hospital from different hospitals, CHC, PHC across the state. But the reason is not at all acceptable and convincing.  The patients who failed to get proper treatment due to lack of infrastructure   or expert and efficient surgeon in any place of the state or their condition got critical   find no option but to come to Sihsu Bhawan with the hope to get best treatment.  It is obvious and expected to get best treatment from the Hospital for the children suffering from   multiple diseases and whose conditions are critical.  As because  there is  huge shortage of  doctor  and staff  and mal-administration,  the  standard of the  treatment in the  Hospital   has deteriorated which has  resulted  in rise of death of infants  in large numbers in different preceding years. So keeping in view the demanding situation and expectation of the people of the state for better treatment of their children, the State Govt. is recommended to intervene immediately to reform the administration in the Institute with filling up all vacancies in the post of Doctor, Nursing Staff  and other staff. The required financial support should be provided for development of infrastructure to meet the need of the Hospital.

2.  The State Govt. with commitment  for restoring  the glory of the Institute should order  for  a Judicial enquiry or a third party enquiry  by AIIMS or ICMR and  mismanagement of  the Hospital. The Govt. should be omitted to implement the recommendation of the agency in letter and spirit for the improvement of this premier institute.

3.  As the standard of the Treatment in District hospitals, Community Health Centre,  Primary Health centre   is deteriorating in all the districts  due to  shortage of doctor, staff and corruption, the people are   found reluctant to carry their patients to these hospitals and rushing to  this Institute  for better treatment. That’s why, this Institute is getting crowded and the number of patients increasing every year. So, the Team recommends  that  the State Govt. should take steps  on war footing way to revamp  and  reform the District Hospitals, CHC, PHC with appointment of required doctors and Staff  to make it well-equipped  to render best health service to the patients in different districts. The effective attention should be  paid  to revamp the  hospitals and Health centres  in tribal regions of the  state. 

4.  The State  Govt. should make  a mandatory  provision  for all the  MBBS passed doctors of all the Medical Colleges to work at least  5 years in Govt. hospitals  in different  districts prior to join in PG Course.

5.  The State Govt. should   strictly  implement the provision of  providing free treatment to the people  living below poverty line  and  the people covered under Rastriya Swasthya Bima Yojana    in any Govt. and private  hospital across the state.   Serious action should be taken  against  those staff  or  authority  violating it.

We, the  representatives  of  Social Action Groups  bring  to your  kind  notice the  following matter  seeking  your  urgent intervention  and necessary  action.

Having gone through the repeated news about series of  child deaths since few days in Sardar Ballav Bhai Patel Paediatric Hospital (Sishu Bhawan), Cuttack, the premier  Institute in the state, the Civil Society Groups felt  concerned about  the incident  and   visited  the Hospital on fact-finding mission  to ascertain the fact  and factors responsible  for such deplorable incident of huge child causalities in old hospital  of the state.  

The  Team  met and discussed  with  Medical staff,  relatives of patients  and  the authority  and wanted to know from  the reason of the   infant causalities  and factors  responsible  for it. After  inspection of Wards and ICU and the  condition of the  children,  the Team  felt that  the situation is  completely  worst  due to  shortage of staff and  doctors, mal administration and corruption. This disaster is man-made  and the administration is completely responsible  for  large scale infant deaths  in the Hospital.

Having been deeply concerned over the   disastrous situation   in  this  Institute, we make the  following  suggestions   for  reforming and revamping  health care system  in the State  in general  and Sishu Bhawan in particular.  The suggestions  are as follows.

ଅଦାଲତୀ ପଞ୍ଚାୟତର ପୃଷ୍ଠଭୂମି

ଅଦାଲତୀ ପଞ୍ଚାୟତ ସମ୍ପର୍କରେ ଆଲୋଚନା କଲା ବେଳେ ଜାତିର ଜନକ ମହାତ୍ମାଗାନ୍ଧୀଙ୍କର ଏକ ଉକ୍ତି ଅତ୍ୟନ୍ତ ପ୍ରାସଙ୍ଗିକ ତଥା ତାତ୍ପର୍ଯ୍ୟପୂର୍ଣ ମନେହୁଏ । ‘‘କେବଳ ବିଧାନସଭାଗୁଡ଼ିକ ଜରିଆରେ କ୍ଷମତା ଆସେ ବୋଲି ଭାବିବାରେ ଆମେ ଦୀର୍ଘ କାଳ ଧରି ଅଭ୍ୟସ୍ତ ହୋଇ ପଡ଼ିଛୁ । ଏହି ବିଶ୍ୱାସକୁ ମୁଁ ସାଂଘାତିକ ଭୁଲ୍ ବୋଲି ମନେକରେ  । ଆମର ଜଡ଼ତା ଓ ମୋହ ଯୋଗୁ ଆମର ଏହି ଭୁଲ୍ ବିଶ୍ୱାସ ସୃଷ୍ଟି ହୋଇଛି । ବିଲାତର ଇତିହାସକୁ ଉପରଠାଉରିଆ ଭାବରେ ଅଧ୍ୟୟନ କରିବା ଦ୍ୱାରା ଆମର ଧାରଣା ହୋଇଛି ଯେ ପାର୍ଲିଆମେଣ୍ଟମାନଙ୍କରୁ ଲୋକମାନଙ୍କ ନିକଟକୁ କ୍ଷମତା ଝରି ଆସେ । ପ୍ରକୃକ କଥା ହେଉଛି, କ୍ଷମତା ଲୋକମାନଙ୍କ ହାତରେ ଥାଏ ଏବଂ ଯେଉଁମାନଙ୍କୁ ନିଜର ପ୍ରତିନିଧି ବୋଲି ବାଛନ୍ତି, ସେହିମାନଙ୍କ ହାତରେ ସେହି ନିର୍ଦ୍ଧିଷ୍ଟ ସମୟ ପାଇଁ କ୍ଷମତା ଦିଆଯାଇଥାଏ  । ପାର୍ଲିଆମେଣ୍ଟର କୋଣସି କ୍ଷମତା ନାହିଁ କି ଜନସାଧାରଣଙ୍କୁ ଛାଡ଼ି ତା'ର ସ୍ୱାଧୀନ ସ୍ଥିତି ମଧ୍ୟ ନାହିଁ ।’’
ଗାନ୍ଧିଜୀଙ୍କର ଏହି ଉକ୍ତିର ଏକ ତାତ୍ତ୍ୱିକ ବିଶ୍ଳେଷଣ କଲେ, ତାଙ୍କର ରାମରାଜ୍ୟ ପରିକଳ୍ପନା ଏବଂ ଗ୍ରାମ ସ୍ୱରାଜ୍ୟ କଥା ଆମ ଦୃଷ୍ଟିକୁ ଆସେ। ଗାନ୍ଧିଜୀ ଚାହୁଁଥିଲେ ସ୍ୱାଧୀନ ଭାରତରେ ପ୍ରକୃତ ଶାସନ କ୍ଷମତା ପାର୍ଲାମେଣ୍ଟଣ୍ଟବା ବିଧାନସଭା ପରିବର୍ତେ ଗ୍ରାମରେ କେନ୍ଦ୍ରୀଭୂତ ହେଉ । କାରଣ ଗାନ୍ଧିଜୀ ଭଲରୂପେ ଜାଣିଥିଲେ ଯେ ଭାରତ ଏକ ଗ୍ରାମବହୁଳ ରାଜ୍ୟ ଏବଂ ଭାରତର ଅସଂଖ୍ୟ ଜନସାଧାରଣ ଯେଉଁମାନେ କି ଦରିଦ୍ର, ସେମାନେ ସମସ୍ତେ ଗ୍ରାମରେ ବାସ କରନ୍ତି । ତେଣୁ ସେ ସ୍ପଷ୍ଟ ଭାବରେ ଜନସାଧାରଣ ତଥା ଦେଶର ଶାସକ ବର୍ଗକୁ ଚେତାଇ ଦେଇ କହିଥିଲେ ଯେ India lives in her villages, ଅର୍ଥାତ୍ ଭାରତୀୟ ଜନଜୀବନର ଏକ ନିଚ୍ଛକ ପ୍ରତିଛବି କେବଳ ତାହାର ଗ୍ରାମ୍ୟଜୀବନରୁ ହିଁ ମିଳିପାରିବ । ଭାରତୀୟ ଗ୍ରାମ୍ୟଜୀବନକୁ ସମୃଦ୍ଧ ଓ ପରିପୁଷ୍ଟ କରିବା ପାଇଁ ସ୍ୱତନ୍ତ୍ର ତଥା ବିଶେଷ ଭାବେ ଗାନ୍ଧିଜୀଙ୍କର ସାମାଜିକ, ରାଜନୈତିକ ଓ ଅର୍ଥନୈତିକ ଚିନ୍ତାଧାର ତଥା ଦର୍ଶନ ଥିଲା । ଏହା ସହ ଗାଁର ଲୋକମାନଙ୍କ ମଧ୍ୟରେ ସର୍ବଦା ଶାନ୍ତି ଓ ସୌହାର୍ଦ୍ୟ ବଜାୟ ରହିବା ଉଦ୍ଦେଶ୍ୟରେ ଗାଁର କଜିଆ ଗାଁରେ ତୁଟୁ ଉପରେ ଗାନ୍ଧିଜୀ ବିଶେଷ ଗୁରୁତ୍ୱ ଆରୋପ କରୁଥିଲେ । ଗାନ୍ଧିଜୀ ଅନ୍ତରର ସହ ଚାହୁଁଥିଲେ ଯେ, ଗ୍ରାମ ଲୋକମାନେ ସେମାନଙ୍କ ମଧ୍ୟରେ ଉପୁଜୁଥିବା ବିଭିନ୍ନ ବିବାଦର ପ୍ରତିକାର ପାଇଁ ଇଂରେଜୀ ଢାଞ୍ଚାରେ ପ୍ରତିଷ୍ଠିତ କୋର୍ଟ କଚେରୀକୁ ବାରମ୍ବାର ଧାଁଦଉଡ଼ କରି ଅଯଥା ଖର୍ଚ୍ଚାନ୍ତ ବା ସର୍ବସ୍ୱାନ୍ତ ନ ହୁଅନ୍ତୁ । ତେଣୁ ସ୍ୱାଧୀନ ଭାରତରେ ଗ୍ରାମମାନଙ୍କର ସର୍ବାଙ୍ଗୀନ ଉନ୍ନତି ପାଇଁ ଗ୍ରାମପଞ୍ଚାୟତକୁ ବିଭିନ୍ନ ଗୁରୁତ୍ୱପୂର୍ଣ୍ଣ କ୍ଷମତା ଦିଆଯିବା ସହ ଏହାକୁ ନ୍ୟାୟିକ (Judicial) କ୍ଷମତା ଅର୍ପଣ କରାଯିବା ପାଇଁ, ଏହାର ଉପାଦେୟତା ସମ୍ପର୍କରେ ଗାନ୍ଧିଜୀ ବିଶେଷ ଭାବେ ଆଲୋକପାତ କରିଥିଲେ । 

ଗାନ୍ଧିଜୀଙ୍କର ଉପରୋକ୍ତ ସ୍ୱପ୍ନକୁ ସାକାର କରିବା ପାଇଁ ଆମର ସମ୍ବିଧାନପ୍ରଣେତାମାନେ ସମ୍ବିଧାନରେ ରାଷ୍ଟ୍ରର ନିର୍ଦେଶାତ୍ମକ ନୀତି (Directive Principles of State Policy)ରେ ପଞ୍ଚାୟତିରାଜ ସମ୍ପର୍କରେ ବ୍ୟବସ୍ଥା କରିଛନ୍ତି । ସମ୍ବିଧାନ ପ୍ରଚଳନର ୪୦ ବର୍ଷ ପରେ, ପୁନଶ୍ଚ ଆମ ଦେଶର ମାନ୍ୟବର ପାର୍ଲାମେଣ୍ଟ ଭାରତରେ ପଞ୍ଚାୟତିରାଜ ବ୍ୟବସ୍ଥାକୁ ଅଧିକ କାର୍ଯ୍ୟକ୍ଷମ ଓ ଫଳପ୍ରଦ କରାଇବା ନିମିତ୍ତ ୧୯୯୩ ମସିହାରେ ୭୩ତମ ସମ୍ବିଧାନ ସଂଶୋଧନ ଅଧିନିୟମ ଜରିଆରେ ସମ୍ବିଧାନର ନବମ ଭାଗରେ ପଞ୍ଚାୟତିରାଜ ସମ୍ପର୍କରେ ଏକ ସ୍ଥାୟୀ ବ୍ୟବସ୍ଥା ସନ୍ନିବେଶିତ କରିଛନ୍ତି । ପଞ୍ଚାୟତ ସମ୍ପର୍କରେ ସମ୍ବିଧାନର ଏହି ନୂତନ ବ୍ୟବସ୍ଥା ଆମ ପାଇଁ ତଥା ଭାରତୀୟ ଜନସାଧାରଣଙ୍କ ପାଇଁ ଯୁଗପତ୍ ଆନନ୍ଦ ତଥା ବିଷାଦର ଏକ ବିଷୟବସ୍ତୁ ରୂପେ ବିବେଚନା କରାଗଲେ ଏହାକୁ ଏକ ତ୍ରୁଟିପୂର୍ଣ୍ଣ ଯୁକ୍ତି (fallacious argument) ରୂପେ ଗ୍ରହଣ କରାଯାଇ ପାରିବ ନାହିଁ  । ନୂତନ ସମ୍ବିଧାନ ସଂଶୋଧନଟି, ଆମ ସମସ୍ତଙ୍କ ପାଇଁ ଏକ ଆନନ୍ଦ ତଥା ଶୁଭଙ୍କର ବିଷୟ ଅଟେ, ଯେହେତୁ ଏହା ପ୍ରଥମଥର ପାଇଁ ଅଥଚ ଅତ୍ୟନ୍ତ ସୀମିତ ସ୍ତରରେ ନିର୍ଦିିଷ୍ଟ ଭାବେ କେବଳ ଅନୁସୂଚିତ କ୍ଷେତ୍ରର ପଞ୍ଚାୟତମାନଙ୍କୁ ନ୍ୟାୟିକା କ୍ଷମତାର ପ୍ରୟୋଗ ପାଇଁ ହକ୍ଦାର କରୁଛି ଏବଂ ସେହେତୁ, କଥିତ ସମ୍ବିଧାନ ସଂଶୋଧନ ଆମ ମନରେ ଅବଶୋଷ, ବିଷାଦ ଓ ଅନୁଶୋଚନାର ଏକ ପ୍ରଶ୍ନବାଚୀ ସୃଷ୍ଟି କରିଛି ଏବଂ ସେପର୍ଯ୍ୟନ୍ତ ଆମର ବିଚାରବନ୍ତ ଓ ସୁଯୋଗ୍ୟ ପାର୍ଲାମେଣ୍ଟାରିଆନମାନେ ଆମ ଦେଶର ପଞ୍ଚାୟତ ବ୍ୟବସ୍ଥାକୁ ସାମଗ୍ରିକ ଭାବେ ନ୍ୟାୟିକା କ୍ଷମତା (Judicial Power) ଅର୍ପିତ କରିବା ପାଇଁ ଉପଯୁକ୍ତ ସାମ୍ବିଧାନିକ ବ୍ୟବସ୍ଥାର ପ୍ରବର୍ତନ ନ କରିଛନ୍ତି ।
ଅଦାଲତୀ ପଞ୍ଚାୟତ ବା ନ୍ୟାୟ ପଞ୍ଚାୟତ ବ୍ୟବସ୍ଥା ଆମ ଭାରତୀୟ ସମାଜ ପାଇଁ କିଛି ନୂଆ କଥା ନୁହେଁ । ଏହା ଆମର ପ୍ରାଚୀନ ଭାରତୀୟ ପରମ୍ପରା ଏବଂ ସଂସ୍କୃତି ଉପରେ ପର୍ଯ୍ୟବସିିତ । ଆମର ପ୍ରାଚୀନ ଶାସନ ବ୍ୟବସ୍ଥାରେ ଏପରି ନ୍ୟାୟଦାନ ବ୍ୟବସ୍ଥା ପ୍ରଚଳିତ ଥିଲା ଏବଂ ଜନସାଧାରଣ ଏହା ଦ୍ୱାରା ଉପକୃତ ହେଉଥିଲେ । ଇଂରେଜମାନଙ୍କର ଭାରତକୁ ଆଗମନ ପୂର୍ବରୁ, ନିର୍ଦିଷ୍ଟ ଭାବେ ଓଡ଼ିଶାରେ ଭାଗବତ ଟୁଙ୍ଗି ବ୍ୟବସ୍ଥା ପ୍ରଚଳିତ ଥିଲା, ଯାହାକୁ ବର୍ତମାନ ସମୟର ଅଦାଲତୀ ପଞ୍ଚାୟତି ବା ନ୍ୟାୟ ପଞ୍ଚାୟତ ସହିତ ତୁଳନା କରାଯାଇପାରେ  ।
ବର୍ତମାନର ନ୍ୟାୟ ପ୍ରଦାନ ବ୍ୟବସ୍ଥା ଅନେକ ସମସ୍ୟାର ସମ୍ମୁଖୀନ । ମାମଲାଗୁଡ଼ିକର ବୃଦ୍ଧି ହେତୁ ଏହା ଅତ୍ୟନ୍ତ ଭାରାକ୍ରାନ୍ତ । ଏଥି ସଙ୍ଗେ ପ୍ରଚଳିତ ନ୍ୟାୟଦାନ ବ୍ୟବସ୍ଥା ଅତ୍ୟନ୍ତ ଖର୍ଚ୍ଚବହୁଳ ଏବଂ ସମୟସାପେକ୍ଷ  । ନ୍ୟାୟ ପ୍ରାପ୍ତିରେ ଅଯଥା ବିଳମ୍ବ ଏହାର ଏକ ଗୁରୁତର ବ୍ୟାଧି। ଅଧିକ ସଂଖ୍ୟକ ବିଚାରପତି ନିଯୁକ୍ତି କରିବା ଓ ନୂଆ କୋର୍ଟମାନ ପ୍ରତିଷ୍ଠା କରିବା ପାଇଁ ରାଷ୍ଟ୍ର ଘୋର ଆର୍ଥିକ ସମସ୍ୟାର ସମ୍ମୁଖୀନ, ଯେହେତୁ ଏହା ଅନେକ ସମସ୍ୟା ଜର୍ଜରିତ  । ନ୍ୟାୟଦାନର ଏହି ବିବିଧ ସମସ୍ୟା - ନ୍ୟାୟାଧୀଶ, ନେତୃବୃନ୍ଦ ତଥା ପ୍ରଶାସକମାନଙ୍କ ପାଇଁ ଏକ ବିରାଟ ଚିନ୍ତାର କାରଣ । ତେଣୁ ନ୍ୟାୟଦାନର ଏପରି ତ୍ରୁଟି ଦୂରୀକରଣ ତଥା ମୂଳୋତ୍ପାଟନ ପାଇଁ ସାରା ବିଶ୍ୱ ସ୍ତରରେ ପ୍ରଚଳିତ ନ୍ୟାୟଦାନର ବିକଳ୍ପ ପଦ୍ଧତି ପାଇଁ ପରିକଳ୍ପନା ତଥା ମାଧ୍ୟମରେ ଚିନ୍ତା କରାଗଲା ଯାହାକି ଇଂରାଜୀ ଭାଷାରେ - Alternative Dispute Resolution Mechanism ବା ସଂକ୍ଷେପରେ ADR ନାମରେ ଖ୍ୟାତ  । ଲୋକ ଅଦାଲତୀ, ମଧ୍ୟସ୍ଥତା ଆଇନ ଓ ଅଦାଲତୀ ପଞ୍ଚାୟତ ଇତ୍ୟାଦି ଏହି ADRର ଏକ ମାଧ୍ୟମ ।
Custom or usage having in the territory of India the force of law - ଲୋକାଚାର ବା ପ୍ରଥା ଓ ଚଳଣି ଯାହା ଭାରତବର୍ଷର ଭୂଭାଗରେ ବିଧିବଦ୍ଧ ରହିଛି ସେସବୁକୁ ଆଇନର ମାନ୍ୟତା ଦିଆଯାଏ  । ସମ୍ବିଧାନର ତୃତୀୟ ଭାଗରେ ମୌଳିକ ଅଧିକାର ଅଧ୍ୟାୟରେ ଏହି ବ୍ୟବସ୍ଥାଟି ଥିବାରୁ ଏହାକୁ ଏକ ମୌଳିକ ଅଧିକାର ବୋଲି କୁହାଯିବ  । ତେଣୁ ସମ୍ବିଧାନର ୧୩ ଧାରା ଅନୁସାରେ ମୌଳିକ ଅଧିକାର ସହ ଅପ୍ରାସଙ୍ଗିକ ବା ତାହାର ବିପରୀତ ବ୍ୟବସ୍ଥା ସବୁକୁ ଅଣସାମ୍ବିଧାନିକ ବୋଲି ଅଦାଲତ ଘୋଷଣା କରିପାରିବେ । ଏ ବିଷୟରେ ଦେଶର ନାଗରିକ ସମାଜ(ସିଭିଲ୍ ସୋସାଇଟି) ନିଜର ମତାମତ ପ୍ରକାଶ କରିବା ଉଚିତ ।

ଆମ ଭାରତର ସମ୍ବିଧାନ ଗୃହୀତ ହେବା ପୂର୍ବରୁ ଗ୍ରାମପଞ୍ଚାୟତ ଆଇନ ୧୯୪୮ ପ୍ରବର୍ତିତ ହୋଇସାରିଥିଲା । ସେ ସମୟରେ ଡ. ହରେକୃଷ୍ଣ ମହତାବ ଥିଲେ ଓଡ଼ିଶାର ପ୍ରଧାନମନ୍ତ୍ରୀ (ସେ ସମୟରେ ମୁଖ୍ୟମନ୍ତ୍ରୀଙ୍କୁ ପ୍ରଧାନମନ୍ତ୍ରୀ ରୂପେ ବିବେଚନା କରାଯାଉଥିଲା) ତେଣୁ ପଞ୍ଚାୟତ ସ୍ତରରେ ସ୍ୱରାଜ୍ୟର କଳ୍ପନାକୁ ସାକାର କରିବା ପାଇଁ ସେହି ଆଇନରେ ଅଦାଲତୀ ପଞ୍ଚାୟତ ପ୍ରତିଷ୍ଠା ନିମନ୍ତେ ବ୍ୟବସ୍ଥା କରିଥିଲେ। ନିୟମାବଳୀର ୭ମ ଅଧ୍ୟାୟରେ ଅଦାଲତୀ ପଞ୍ଚାୟତ କିପରି ଗଠିତ ହେବ ଓ କେଉଁ କେଉଁ ବିଷୟରେ ଅଦାଲତୀ ପଞ୍ଚାୟତର କ୍ଷମତା ବିସ୍ତାର ଲାଭ କରିବ ତାହାର ସଂପୂର୍ଣ ଚିତ୍ର ସେହି ଆଇନରେ ପ୍ରଦାନ କରାଯାଇଥିଲା । କିନ୍ତୁ ଅଳ୍ପ କୋତେଟି ସ୍ଥାନରେ ଏହି ଆଇନ କାର୍ଯ୍ୟାରମ୍ଭ କରିବାର ସୁଯୋଗ ପାଇଲା। ଅନ୍ୟାନ୍ୟ ଜିଲ୍ଲାରେ ଧୀରେ ଧୀରେ ତାହା ପ୍ରସାରିତ ହେବ ବୋଲି ଆଶା କରାଯାଇଥିଲା। କିନ୍ତୁ ତାହା ସମ୍ଭବ ହେଲା ନାହିଁ । ଫଳରେ ଯେଉଁ ଜିଲ୍ଲାରେ ଏହା ଆରମ୍ଭ ହୋଇଥିଲା ସେଠି ମଧ୍ୟ ଏହି ଅଦାଲତୀ ପଞ୍ଚାୟତ କ୍ରମାଗତ ଭାବେ ବନ୍ଦ ହୋଇଗଲା।
ସମ୍ବିଧାନ ଗୃହୀତ ହେଲା ପରେ ୨୬ ଜାନୁଆରୀ ୧୯୫୦ରୁ ତାହା କାର୍ଯ୍ୟକାରୀ ହେଲା । ତହିଁର ୨୪୬ଧାରା ଅନୁସାରେ ୭ମ ପରିଶିଷ୍ଟରେ ୩ଟି ତାଲିକା କେନ୍ଦ୍ର, ରାଜ୍ୟ ଓ ଯୁଗ୍ମ ତାଲିକା ରୂପେ ସନ୍ନିବିଷ୍ଟ ହେଲା । ରାଜ୍ୟ ତାଲିକାରେ ୫ଦଫା (Item No.5)ରେ ଗ୍ରାମ୍ୟ ଶାସନ ଓ ସ୍ଥାନୀୟ ସ୍ୱାୟତ୍ତଶାସନ ପାଇଁ ଆଇନ କରିବାର ଅଧିକାର ରାଜ୍ୟ ହସ୍ତରେ ନ୍ୟସ୍ତ କରାଗଲା । ତଦନୁଯାୟୀ ଗ୍ରାମପଞ୍ଚାୟତ ଆଇନ ଓ ତା'ର ନିୟମାବଳୀ ଥିଲା ରାଜ୍ୟର ବିଷୟବସ୍ତୁ । ଅତଏବ ଅଦାଲତୀ ପଞ୍ଚାୟତର କଳ୍ପନା ଓ ତାହାକୁ ଦିଆଯାଇଥିବା କ୍ଷମତାବଳୀ ରାଜ୍ୟର ଅଧିକାର ପରିସରଭୁକ୍ତ ଥିଲା  ।
ସମ୍ବିଧାନର ୧୭ ଧାରାରେ ଅସ୍ପୃଶ୍ୟତା ଉଠାଇ ଦିଆଯାଇଥିବାରୁ ଧୀରେ ଧୀରେ ଦେଖାଗଲା ଯେ ରାଜ୍ୟର ପ୍ରଶାସନ ଏଭଳି ପଞ୍ଚାୟତରେ ଉଚ୍ଚଜାତିର ଲୋକମାନଙ୍କ ଆଇନ ଭଙ୍ଗର ସୁଯୋଗ ଦେବ ବୋଲି ଆଶଙ୍କାକରି ଏହି ଆଇନକୁ ଅନିର୍ଦିଷ୍ଟ କାଳ ପାଇଁ କାର୍ଯ୍ୟକାରୀ କରାଗଲା ନାହିଁ । ବିଷୟଟି ପୁନର୍ବାର ଉଜ୍ଜୀବିତ ହେଲା ଯେତେବେଳେ ୭୩ତମ ସାଂବିଧାନିକ ସଂଶୋଧନ ଅଧିନିୟମ ଦ୍ୱାରା ୨୪.୦୪.୧୯୯୩ରେ ପଞ୍ଚାୟତକୁ ଏକ ସ୍ୱତନ୍ତ୍ର ଅଧ୍ୟାୟ ରୂପେ ସମ୍ବିଧାନରେ ସଂଯୁକ୍ତ କରାଗଲା । ଏହି ନବୀନ ସଂସ୍କରଣ ପାଇଁ ୨୪୩-ଗ(୪)(ଭ) ଧାରାରେ ବ୍ୟବସ୍ଥା ରହିଲା ଯେ, ଆଇନ ଦ୍ୱାରା ପାର୍ଲାମେଣ୍ଟ ଏହି ଭାଗକୁ ଅନୁସୂଚୀତ ଅଞ୍ଚଳ ଏବଂ ଜନଜାତି ଅଞ୍ଚଳକୁ ପ୍ରସାରିତ କରିପାରିବେ  ।
ତେଣୁ ଗୋଟିଏ ନୂତନ ଆନ୍ଦୋଳନ ମୁଣ୍ଡ ଟେକିଲା। ବହୁ ସ୍ୱେଚ୍ଛାସେବୀ ସଂସ୍ଥା ଏଥିରେ ଭାଗ ନେଲେ। ଓଡ଼ିଶାରେ ମଧ୍ୟ ଏ ଆନେ୍ଦାଳନ ପ୍ରତି ଗଭୀର ଶ୍ରଦ୍ଧା ଓ ସହଯୋଗ କରାଯାଇଥିଲା । ଭାରତ ଜନଆନ୍ଦୋଳନ ରୂପେ ପରିଚିତ ଏହି ସିଭିଲ ସୋସାଇଟିର ଉଦ୍ୟମ ରୂପରେଖ ନେଇ ୧୯୯୬ରେ ୪୦ ନମ୍ବର ଆଇନ୍ରେ ଅନୁସୂଚୀତ ଅଞ୍ଚଳକୁ ପଞ୍ଚାୟତ ସମ୍ପ୍ରସାରଣ ଆଇନ ରୂପେ ପ୍ରସାରିତ ହେଲା । ୨୪.୧୨.୧୯୯୬ରେ ଏହି ସମ୍ପ୍ରସାରିତ ଆଇନ୍ ରାଜପତ୍ରିତ ହୋଇ ଲାଗୁ ହେଲା । ପୁଣି ସୁଯୋଗ ମିଳିଲା ସମ୍ବିଧାନର ୧୩ ଧାରାକୁ ଏକ ଆଇନ ଆକାରରେ ରୂପରେଖ ଦେବା ବିଷୟରେ ।
ସମସ୍ତଙ୍କ ଅବଗତି ନିମନ୍ତେ ଏହି ଆଇନ୍ର ୪ର୍ଥ ଧାରାର (ଘ) ଉପଧାରା ଏଠାରେ ଅନୁଦିତ ହେଲା:- ""ପ୍ରତ୍ୟେକ ଗ୍ରାମସଭା ଲୋକମାନଙ୍କ ପ୍ରଥା, ପରମ୍ପରା, ସେମାନଙ୍କ ସଂସ୍କୃତି ପରିଚୟ (Culture Identity) ଗୋଷ୍ଠୀ ସମ୍ବଳ, ପ୍ରଥା, ଚଳଣି ଓ ଲୋକାଚା ଭିତ୍ତିକ ବିବାଦ ସମାଧାନ ଆଦିକୁ ସଂରକ୍ଷଣ ଓ ସୁରକ୍ଷା ଦେବା ପାଇଁ କ୍ଷମତାପନ୍ନ ହେବେ ।''
୧୯୯୭ ଡ଼ିସେମ୍ବରରେ ଓଡ଼ିଶାର ପଞ୍ଚାୟତ ଆଇନର ସଂଶୋଧନ କରାଯାଇ ଓଡ଼ିଶା ଗ୍ରାମପଞ୍ଚାୟତ ଆଇନ୍ ୧୯୬୫ର ବିଭିନ୍ନ ଧାରାରେ ଅନ୍ତର୍ଭୁକ୍ତ କରାଗଲା । ଏଥିରେ ଓଡ଼ିଶାର ସ୍ୱେଚ୍ଛାସେବୀ ସଂସ୍ଥାମାନଙ୍କର ଅବଦାନ ଥିଲା ବ୍ୟାପକ ଓ ଗଭୀର।
ଏଥର ଗ୍ରାମସଭା ବିଷୟରେ ଆଲୋଚନା କରାଯାଉ। ଓଡ଼ିଶା ଗ୍ରାମପଞ୍ଚାୟତ ଆଇନ୍ ୧୯୬୫ର ପଞ୍ଚମ ଧାରାରେ ଗ୍ରାମସଭା ଏବଂ ତାହାର କୃତ୍ୟ (function) ବର୍ଣ୍ଣନା କରାଯାଇଛି। ୨୨.୧୨.୧୯୯୭ରେ ଏହି ପଞ୍ଚମ ଧାରାରେ ୩ୟ, ୪ର୍ଥ, ୫ମ ଓ ୬ଷ୍ଠ ଉପଧାରା ନୂଆକରି ସଂଯୁକ୍ତ କରାଯାଇ ଗ୍ରାମ ଶାସନର କାର୍ଯ୍ୟ କ'ଣ ତାହା ବର୍ଣ୍ଣନା କରାଯାଇଛି  । ୬ଷ୍ଠ ଉପଧାରାରେ ବର୍ଣିତ ରହିଛି ଯେ - ‘‘ପ୍ରତ୍ୟେକ ଗ୍ରାମସଭା ଲୋକମାନଙ୍କ ପ୍ରଥା, ପରମ୍ପରା, ସେମାନଙ୍କ ସଂସ୍କୃତି ପରିଚୟ(Culture Identity), ଗୋଷ୍ଠୀ ସମ୍ବଳ, ପ୍ରଥା, ଚଳଣି ଓ ଲୋକାଚାର ଭିତ୍ତିକ ବିବାଦ ସମାଧାନ ଆଦିକୁ ସଂରକ୍ଷଣ ଓ ସୁରକ୍ଷା ଦେବା ପାଇଁ କ୍ଷମତାପନ୍ନ ହେବ ।’’ ଏହି ରୂପେ ଉପରୋକ୍ତ ମନ୍ତବ୍ୟ ସମ୍ବିଧାନ ଓ ପଞ୍ଚାୟତ ଆଇନଗୁଡ଼ିକରେ ଲେଖାଯାଇଛି  ।

ଏହି ଗ୍ରାମ ପଞ୍ଚାୟତ ଆଇନରେ ଗ୍ରାମଶାସନର ସଂଜ୍ଞା ଦିଆଯାଇଛି । ଗ୍ରାମସଭାର ସଂଜ୍ଞା ଦିଆଯାଇନାହିଁ । ତଥାପି ୧୯୯୭ର ସଂଶୋଧନ ସମୟକୁ ଦେଖାଗଲା ଯେ ଗ୍ରାମଶାସନ ଯାହା ଗ୍ରାମସଭା ମଧ୍ୟ ତାହା । ଏଥିପାଇଁ ୫ମ ଧାରାର ୨ୟ ଉପଧାରା ତାତ୍ପର୍ଯ୍ୟପୂର୍ଣ। ସେଥିରେ ଗ୍ରାମସଭାର କୋରମ୍ ମୋଟ ସଭ୍ୟସଂଖ୍ୟାର ଏକ ଦଶମାଂଶ ରହିବ ବୋଲି ଉଲ୍ଲେଖ କରାଯାଇଛି ।

ଗ୍ରାମଶାସନ (Village administration)ର ଉଲ୍ଲେଖ ରାଜ୍ୟ ତାଲିକାରେ ରହିଛି ବୋଲି ଏହି ପ୍ରବନ୍ଧରେ ପୂର୍ବରୁ ଦର୍ଶାଯାଇଛି । ତେଣୁ ସରକାରଙ୍କ ଦୃଷ୍ଟିୁର ଗ୍ରାମଶାସନର ଅନ୍ୟନାମ ହେଲା ଗ୍ରାମସଭା । କିନ୍ତୁ ୫ମ ଧାରାରେ ୬ଷ୍ଠ ଉପଧାରା ପାଇଁ ଏ ପର୍ଯ୍ୟନ୍ତ ନିୟମାବଳୀ ହୁଏତ ତିଆରି କରାଯାଇ ନାହିଁ ବା ଲାଗୁ କରାଯାଇ ନାହିଁ । ଫଳସ୍ୱରୂପ ଆମ ପାଖରେ ସୂଚନାର ଅଭାବ ରହିଛି ଯେ ଗ୍ରାମସଭା ଅଦାଲତୀ ପଞ୍ଚାୟତକୁ ବା ନ୍ୟାୟ ପଞ୍ଚାୟତକୁ କିପରି ଭାବେ କାର୍ଯ୍ୟକାରୀ କରିବ  ।

ଉପରେ ଯାହା ଉଲ୍ଲେଖ କରାଗଲା ତହିଁରୁ ଜଣାପଡ଼େ ଆଇନକୁ ଆମର ଅମଲାତନ୍ତ୍ର ଓ ନିର୍ବାଚିତ ପ୍ରତିନିଧିମାନେ କେଉଁ ଉପାୟରେ ମୋଡ଼ିମାଡ଼ି ଅକାମୀ କରିଦେଇ ପାରନ୍ତି । ଏବେ ସୂଚନା ଅଧିକାର ଏକ ଆଇନ ହେବା ସତ୍ତ୍ୱେ ତାହାର ମଧ୍ୟ କେନ୍ଦ୍ରୀୟ ନିୟମାବଳୀ ତିଆରି ହୋଇନାହିଁ । ଫଳ ସ୍ୱରୂପ ଅଦାଲତୀ ପଞ୍ଚାୟତ ବା ନ୍ୟାୟ ପଞ୍ଚାୟତ ପ୍ରତିଷ୍ଠା କରିବା ପାଇଁ ଥିବା ବାଧା କିପରି ଦୂର କରାଯିବ ଓ ଗ୍ରାମ ସ୍ୱରାଜର ପଥ ପ୍ରଶସ୍ତ କରାଯିବ ତାହା ସ୍ପଷ୍ଟ ଜାଣିହେଉ ନାହିଁ ।
ଅନ୍ୟ ଏକ ଉଦାହରଣ ମଧ୍ୟ ବିଚାରକୁ ନିଆଯାଇପାରେ । ଓଡ଼ିଶା ଭୂ-ଦାନ ଗ୍ରାମଦାନ ଆଇନ, ୧୯୭୦ ତାହାର ସଂଜ୍ଞା ପ୍ରକରଣରେ ଗ୍ରାମଦାନଗ୍ରାମ ପରିଷଦର ଅର୍ଥ ପ୍ରଦାନ କରିଛି  । କିନ୍ତୁ ଗାଁରେ ବାସ କରୁଥିବା ସମସ୍ତ ମତଦାତାମାନଙ୍କୁ ନେଇ ଗ୍ରାମପରିଷଦ ଗଠିତ ହେବ ବୋଲି ବ୍ୟବସ୍ଥା ଥିଲେ ମଧ୍ୟ ଓଡ଼ିଶା ଗ୍ରାମପଞ୍ଚାୟତ ଆଇନର ଗ୍ରାମସଭା ପଲ୍ଲୀସଭା ସଙ୍ଗେ ଏହି ଗ୍ରାମପରିଷଦର ସମ୍ପର୍କ କ'ଣ ତାହା ଏହି ଉଭୟ ଆଇନରୁ ଜଣାପଡ଼ି ନାହିଁ । ପରିଣାମ ସ୍ୱରୂପ ନ୍ୟାୟ ପଞ୍ଚାୟତ ବା ଅଦାଲତୀ ପଞ୍ଚାୟତ କେଉଁ ଆଇନର ଅନ୍ତର୍ଗତ ହେଲେ ଅଧିକ କାର୍ଯ୍ୟକ୍ଷମ ହେବ ତାହାକୁ ଅସ୍ପଷ୍ଟ କରି ଦିଆଯାଇଛି । ଏଥିରେ ଆମେ ଅଦାଲତୀ ପଞ୍ଚାୟତ ସମ୍ପର୍କୀୟ ସମସ୍ତ ଆଇନଗୁଡ଼ିକୁ ଓଡ଼ିଶାରେ ଭାଷାନ୍ତର କରି ଆଲୋଚନା କରିଅଛୁ  । ଆଶା କରାଯାଏ ଯେ, ଏହି ତଥ୍ୟକୁ ଆଧାରକରି ଅଦାଲତୀ ପଞ୍ଚାୟତ ଉପରେ ଏକ ଜନ ଆନ୍ଦୋଳନ ସୃଷ୍ଟି ହୋଇ ଏହା କାର୍ଯ୍ୟକାରୀ ହେବ ।

Intervention of PM sought for arrest of Satish Gajbhiye controversial IPS officer


Intervention of Prime Minister sought by Civil Society Groups   for arrest of Satish Gajbhiye, controversial IPS officer  of Odisha and handing over the case of his illegal accumulation of property to CBI



On 20.8.15, the Civil Society Groups of Odisha submitted memorandum to  Sri Narendra Modi, Prime Minister of India seeking immediate intervention of the Central Government  for taking drastic action against Sri Satish Gajbhiye, IPS Officer, who assaulted, manhandled and mercilessly beaten up a peaceful assembly of people including lawyers and journalists during their protest against fraudulent God-Man Baba Sarathi in Kendrapara of Odisha and his misdeed of illegally acquiring huge land of Dalits and Govt. land in the name of her wife Mrs. Ranjana Gajbhiye.

In the memorandum, the members of Civil Society Groups have alleged that after the shocking and sensational revelations about swindling, womanisation and  land-grabbing by the self-styled God-Man Baba Sarathi of Kendrapara district, a vast crowd of  common people including  concerned citizens and intellectuals  came out to the street on 5.8.15  to register their protest  and raise their demand for an enquiry into the whole episode.  While the leaders of ruling BJD remained mute spectators, the rank and file of all opposition political parties   along with Social organisations staged a united protest demanding immediate arrest of Sarathi Baba and a CBI enquiry into the whole lot of nefarious misdeeds of Sarathi Baba and his collaborators within and outside Government. As days passed by with no legal or administrative action taken by the State Government, thousands of people to press for their demand resorted to   demonstration and rasta roko at Kendarapara.  They also surrounded the Ashram and kept raising slogans against the police protection given to Sarathi Baba. At this moment Sri Satish Gajbhuye, Superintendent of Police, Kendrapara leading a huge police force rushed to the place of mass protest himself and let loose a reign of terror in the whole area to disperse the mob by   indiscriminately lathicharging and teargasing the protestors and heaping all sorts of inhuman brutalities on them.  Mr. Gajbhiye did all this simply to protect any how the fraudster Godman from the natural wrath of people. 

  Bharatiya Janata Party   gave a call for Bandh in Kendrapara on 7.8.15 in protest against the highhanded action of SP Sri Gajbhiye who had ordered the police force to employ all sorts of brutalities to disperse the protesting crowd from the street and ensued a classic road fighting   between the armless innocent people and the armed police force in Kendrapara town. In the process the police injured hundreds of people, made many people kneel down on the ground with their hands being tied to the back. The SP himself ruthlessly misbehaved and physically assaulted Sri Duryodhan Sahu, a lawyer and President, BJP District Unit using abusive   language which was incidentally telecast in TV Channels in real time. The SP also threatened reporters of electronics media to leave Kendrapara at once.    

This incident evoked spontaneous response from the people across the state to protest and demand immediate arrest of SP Sri Gajbhuye. Sri Prasad Harichandan, President of Congress Party with his entourage visited Kendrapara and condemned police attack and demanded high level inquiry into this incident along with immediate arrest of the SP. Sri Bijay Mohapatra, senior leader of BJP while addressing a press meet portrayed the police action as Taliban terrorism and demanded arrest of SP and CBI enquiry into whole incident. On 8th Aug, the Lawyers of different Bars of the State not only condemned police atrocities but also demanded immediate arrest of SP.  The Orissa High Court Bar Association along with other Bar Associations declared the suspension of court till 14th August expressing solidarity with the people of Kendrapara who were brutalised by the SP.

 Being pressurised by huge public protest, the State Govt. has suspended Satish Gajbhiye on 13.8.15. But this move has not satisfied the public. The state-wide movement and protest demanding arrest of Staish Gajbhiye is still going on. On 13.8.15, Bharatiya Janata Party organised demonstration in front of office of Director General of Police, Cuttack demanding arrest of Satish Gajbhiye and CBI inquiry into the whole episode. Congress Party had also organised demonstration on 17.8.15 in front of Governor House demanding arrest of Sri gajbhiye and CBI enquiry into the incident.  The whole situation is still tense in the state. Every day, there are Dharanas and rallies being held by different organisations demanding arrest of SP across the state.

 Going against the norms of All India Service Conduct Rules, Sri Gajbhuye dares to publicise his utterly untenable opinions in FACEBOOK and elsewhere justifying his attack on the people including journalists and lawyers. He is also threatening the media houses to sue them by filing defamation case against them.

In the meantime, the Civil Society Groups have already exposed the fact of accumulation of huge landed property by Mr. Gajbhiye in the name of his wife Mrs. Ranjan Gajbhiye  in Gop  Block of Puri district  along with investment of crores of rupees  for commercial fishery by illegally acquiring around 22 acres of Gochara and Anabadi land. It has also been alleged by the people that he had accumulated huge money from fraudulent Chit fund Companies by invested his shares with them and by giving them various illegal benefits. A few days back, he was interrogated by the CBI for his link with Chit Fund Companies. On the land illegally acquired by him in the name of his wife, he has started digging big ponds for fishery cultivation with huge investment of more than 40 crores.  So it is now evident that he has obtained such spurious money from Chit Fund sources or from Baba Sarathi, for which   the Civil Society Groups have demanded a thorough going enquiry into Mr. Gajbhiye’s illicit connections.  In the meantime, FIR has been lodged in Gop police station on 19.8.15 against Satish Gajbhiye for his land grabbing through illegal and fraudlent means in connivance of fraud chit fund brokers.

Ironically, without taking any action against this officer, the State Govt. is trying to shield him by giving order for enquiry one after another like Crime Branch enquiry, Vigilance enquiry and RDC level enquiry with no results. The people of the state are getting frustrated over the inaction of the Govt. and giving protection to a corrupt officer.

FIR lodged and CBI inquiry demanded into Land Scam of Satish Gajbhiye IPS



FIR lodged  and Public Meeting organised at Gop of Puri district in support of Demand for CBI inquiry into Land Scam of Satish Gajbhiye, IPS officer, Odisha


As part of the Campaign  drive  by Civil Society Groups in support of their demand for arrest of  corrupt IPS officer Sri Satish Gajbhiye, former SP, Kendrapara who is under suspension, Mass Public Meeting  was organised on 19.8.15 at Gop Block headquarter  of Puri districts. Hundreds of the people of Gop and Nimapara block   had gathered to express their solidarity with the Activists to put pressure on Govt. for arrest of Sri Gajbhiye. The meeting started at 5 PM with Sri Punesh Kumar Senapati, Social Activist presiding over the meeting and giving brief introduction about incident of huge land illegally acquired by Sri Satish Gajnbhiye in Gop area. He delivered lengthy speech  starting from swindling, womanisation and  land-grabbing by the self-styled God-Man Baba Sarathi of Kendrapara to police atrocity  on the people registering their protest   against the police inaction  and providing protection to Baba Sarathi. The issues relating to land scam by Satish Gajbhiye was discussed in the meeting. All the speakers highlighted misdeeds of Nabin Patnaik Govt., growing corruption in every field and state protection to corrupt Ministers IAS and IPS officers who have illegally accumulated crores of rupees through corrupt ad fraudlent practice.  Nabin Patnaik is deceiving the people in the name of transparent Govt. But in practice, there is no transparency in administration.  All the speakers justified their stand for demand for CBI enquiry and explained about the reason behind their demand for CBI inquiry. The local speakers also spoke  about how the land is being barren and affected due to water logging artificially created by big ponds developed by Satish Gajbhiye.  The crowd supported it and extended their support to Civil Society Groups spearheading campaign on land scam in Odisha.

The Speakers  who addressed the meeting  were  Sri Sudhir Mohaty, advocate  and Secretary, Odisha Durniti Sangharsa Manch, Mr. Ratanakar Mallik, Sri Dibakar Nayak, RTI Activist, Sri Brahmanad Mallik, eminent Senior Citizen, Sri Pradip Pradhan, RTI Activist and State Convener, Odisha Soochana Adhikar Abhijan, Sri Ashok Mallik, State President, NACDOR, Sri Pratap Sahu, President, Basti Sangharsh Samiti, Sri Abdul Walli etc.

FIR  was  lodged  in Gop  Police Station  against Satish Gajbhiye and Ranjan Gajbhiye  for illegally acquiring land in Gop area.  The police   has not registered the case till yet
