Performance of Advisor to State Planning Board in Odisha



Since several years, State Govt. has deliberately kept State Planning Board non-functional in Odisha.   To satisfy their party leaders,  the State Govt.  has appointed in 2009 Sri Surendra Nayak, former Minister  and  Sri  G. Bhaskar Roy, BJD leader  in 2015 as Vice-chairman of  the Board.  These vice-chairman have never conducted a single meeting of the Board.  The meeting of State Planning Board  has  not been held  since 8 years.   

However, on 13.11.2014,  the State Govt.  appointed Sri R.N.Das, retired bureaucrat as advisor to State Planning Board, Odisha when there is no  functioning of the  Board.   It is very interesting to be noted here that State Planning Board has not been constituted till yet.  

Now,  the question comes,  whom the advisor is giving advice when there is no planning board.   To make an query about performance of Advisor to State Planning Board, Application was filed  to the PIO, Dept. of Planning  and Convergence, Govt. of Odisha   seeking information  about his appointment, work entrusted to , his performance as Advisor  in the state.  On dated 7.10.16, the PIO  has provided the following information.

1.       The State Govt. vide resolution no. 14834/P, Bhubaneswar, dt. 13.11.2014 appointed Shri R.N.Das, former secretary to Govt. of India as Advisor to the State Planning Board.  He will focus on Skills Mission,  food production,  Food Security Mission and shelter etc.

2.       The information   was sought about copy of the documents relating to advice, if any given by him to State Govt.  But  the PIO  has declined  to provide  that document. Rather he has provided   two-page note on advice given to   different Dept.    The gist of the note is as follows.

a.    Agriculture Dept.  has been advised  for long term arrangements to be made  for timely supply  of certified seeds to the farmers for paddy, oilseeds like mustard and groundnuts , special initiative  for production of  sufficient  quantity of  certified seeds inside the state.    

b.    He has conducted meeting with Secretary and other officials of MSME, ET &ET, IT and PR Departments.  Besides that  meetings  have been held with private organisations  such as  the IL & FS, and L& T  which are engaged  in implementing  skill development programme with a view to expanding  their activities  in this regard.

c.      Rural housing/ shelter progress of implementation in the districts  has been monitored  from time to time.  The advisor  also visists  different districts  to review the development  activities  and implementation of  different schemes  of Govt. by  the collectors.

d.    Revamping  the planning proess both at  state level ad distriuct  level with the objective to make it more professional ad people’s oriented, the Govt.  has constituted  a committee  to suggest comprehensive measures  to strengthen planning  process and institutional  arrangements. The Advisor    has been appointed  as  Chairman of the  committee.

3.    The Advisor  has  been provided free   accommodation,  four-wheeler, personal staff, telephone,  refreshment, periodical charges, stationary articles etc.  He  has not received  salary and allowances till yet.  In July, 2016,  the State Govt.  has paid  Rs. 13,70,000/-  towards medical  expenses     and payment of Air Ambulance  for his treatment.

 While addressing press meet in august 2016,  Sri Arun Sahu, Minister for Panchayat Raj said within short span of 4 months (from April to July 2016), the Govt. has been able  to  generate 4 crore employment ( man-days) under NREGA in Odisha by spending Rs. 1130 crores.  . It was unbelievable how the Govt. generates such huge employment (mandays) in Odisha which has never happened in Odisha. To understand it and employment generated in previous years, RTI Application was submitted to Department of Panchayat Raj, Govt. of Odisha seeking information about details of fund earmarked and   expenditure made with generation of mandays by Govt.  from 2010-11 to 2016-17.  The PIO has provided the information available with him upto august 2016.

The information sought for is as follows.

i. Provide information about total fund sanctioned by Central Govt. and from State budget for NREGA in Odisha as per the following format

Analysis
A.   Since last five years (from 2011-12 to 2015-16), the State Govt.  has generated 6  crores of man-days  under NREGA   in an average in a year. How the State Govt. generated 4 crores  man-days  within 4 months. It means one crore in a month. It is just data manipulation  of the figure  showing record number of mandays generated by Govt.
B.    It  has also been found  in different districts  from Puri to Malkangiri  that  the NREGA labourers  are  not paid  their  dues  for  months  together, though the work  gets  completed.

In the month of May, 2016,   while addressing the press, Sri Arun Sahu, Minister of State for Panahayat Raj and Law said that the State Govt.  has completed  a record number of 10 lakh houses  under Rural Housing Scheme i.e.,  Biju Pucca Ghara Yojana  within two years ( from 2014 to 2016) giving a big credit to State Govt. The Hon’ble Minister also declared that the effort of the State Govt. to provide   such a huge quantity of house to rural poor has been highly appreciated at national level.  After the declaration and news published in  print and electronic media, RTI Application  was submitted to the PIO, office of Panchayat Raj, Govt. of Odisha  on 19.5.16 seeking  the following information

A.   Details of allocation of fund  made for construction of houses under various Rural Housing Scheme in the state ( year-wise).
B.   Details of allocation of fund to different districts  and fund utilised  by each district under Rural Housing Scheme.
C.     Photocopy of the information  following  which  the state  Govt.  has declared  about completion of 10 lakhs houses  under  Rural Housing Scheme within two years.
D.   Proof of Document  about the effort of the State Govt. to provide   such a huge quantity of house to rural poor has been highly appreciated at national level.
E.    Total no. of   houses completed under Rural Housing Schemes within last two years (district-wise).
F.    Total no. of   houses completed under Biju Pucca Ghara Yojana (BPGY) within last two years (district-wise).

Comments: While the Central Govt.  has allocated  Rs. 3044.90 crores within two years, the State Govt. has allocated just 1030. 10 crores which is  just 30 % of the central allocation.

Comments: when  there is  utilisation of Rs. 201 crore against allocation of 1030.10 crores, how the State Govt. could draw   the conclusion  that  10 lakh houses  has been completed. 

3.      With regard to completion of 10 lakh houses,  the PIO has asked to visit  portal  www.rhodisha.gov.in.   and awaasSoft ( iay.nic.in) to get the complete information about details of house constructed  under these schemes.

Comments:  While  browsing the website  it  was  found  that  no information is available  about it.  The website is blank.  The information was sought in card copy. Why the PIO has written to visit website. Because, the declaration made by Minister, Panhayat Raj is false.  

4.      No information about  “the effort of the State Govt. to provide   such a huge quantity of house to rural poor has been highly appreciated at national level” is not available. It   was just self-declaration by  the Minister because this declaration  is not based on fact. It was  false  and fabricated.

Appeal to file complaint to State Food Commission on Ration Card issue

An Open Appeal to all concerned to help deprived people file complaint directly to State Food Commission in respect of denial of Ration Card to eligible Households under National Food Security Act



All of you are aware that  National  Food Security Act, 1913  has  the mandate  to provide  food and nutritional security in human life cycle approach  by ensuring  access to adequate quantity of quality food at affordable  price to  all the people  to live with  dignity. As per section 10 of the Act,  each State Govt.  is required   to  carry out  exercise  to identify   the eligible  Household  termed  as priority  households  and  the beneficiaries  to be covered under Antodaya Anna Yojana within one year  ( by July 2014) of the  implementation of NFSA.

In fact, in 2014 Govt. of Odisha started exercise to identify eligible Household (HH) and beneficiaries to be covered under Antodaya Anna Yojana and took one year to complete the survey and prepare the list of Priority Households and beneficiaries under AAY. The whole process completed by October 2015. But during  that time  it  was found that  thousands of  poor people, tribals, dalits  have been deprived  to get  ration card due to  corruption, favouritism,  nepotism.  Thousands of rich people got succeeded to get the ration card by manipulating the procedure and influencing the officials or unholy alliance with the officials.   However after hue and cry and rasta roko and gherao organised by political parties  and Civil Society Groups  in different places in protest against   exclusion of the poor in the list of eligible HHs,  the State Govt. made a request to file complaint  in the block office which will be enquired  by BDO and  action to be taken  accordingly. 

Thousands of complaints were filed in the block office to get the ration card. But their complaints were neither heard nor enquired. Rather it found gathering dust in the block office.

In January, 2016, when the State Govt. designated State Information Commission as State Food Commission to receive complaints from the people,  Right to Food Campaign, Odisha and other Civil Society Groups  filed  5000 complaints  to State Information Commission about denial of ration card to them.  But these complaints were simply stored in the office of State Information Commission for months together due to lack of resources and staff shortage.  Keeping it in view, demonstration was organised in Bhubaneswar demanding constitution of independent State Food Commission.  Then, being pressurised, the State Govt.  constituted State Food Commission in June 2016  with appointment of Chairman and two members.
In the last month,  I had the opportunity  to meet   the whole body of State Food Commission for discussion  about  my complaint on child death issue in Malkangiri. During discussion, I appraised the Commission about pendency of 5000 complaint cases  for ration card.  The Commission assured me to take steps  in this regard.  Now,  State Food Commission  has started   issuing order to concerned  authorities  to enquire into the complaints  and take  action  accordingly.  It has come to my notice  from  grass-root level  that   enquiry  has started  and many people  have got  the  card.

So, I appeal all the Activists and the organisations working for the poor  to  organise  the people  and help them write complaints  ad file it to the Chairman,    State Food Commission, Toshali Bhawan, Satya Nagar, Bhubaneswar-751007. The complaint shall  be written in plain paper and in Odia. It should be hand-written. Thousands of complaints should be filed to Commission with appeal to provide ration card within 7 days.

If the poor people could not get justice within a stipulated time period, the Civil Society Groups  will steer public action  at state  and district level to enforce the right  and entitlement of the people  as mandated  under NFSA.

Memorandum submitted to Chief Secretary, Odisha demanding  Land Patta to Slum-Dwellers  in Bhubaneswar, capital  City of Odisha

On 5.12.16,  a  Civil Society delegation  submitted memorandum  to Sri Aditya Prasad Padhi, Chief  Secretary, Govt. of Odisha  demanding  allotment of land/plot to Slum-dwellers  residing   under Jurisdiction  of Bhubaneswar Municipal Corporation  (BMC)  and  discussed  with him  about possible modalities to carry out this work, if the Govt. took it as policy decision.  It was suggested   to State Govt.    (a) to  undertake  thorough  exercise  to identify  the eligible  slum-dwellers  in different slums  in Bhubaneswar and  lease out   atleast  900 sq. ft. of  land to each family  following the procedure  which has been made  while allotting land to IAS, IPS officers, Ministers, MLAs  etc., (b)  recover  thousands of acres of  land  illegally acquired  by  influential persons, private  bodies  in the city,  (c) undertake comprehensive land planning by  dividing  land into  five categories  and reserving land  for  slum-dwellers  in different locations of Bhubaneswar, as per Odisha Govt. Land Settlement  Rules, 1983, (d) enactment of new land  recognizing  the  property right of Slum-dwellers  in slums of  urban areas  following Central Govt. Model Act, 2011, (e) frame  a comprehensive Slum Development Policy  recognizing  right to Slum-dwellers  to  access land  in urban areas. Background  of  the Demand  for  land  by Slum-Dwellers
Since last few years,  Bhubaneswar  has witnessed   migration  of  large number of poor people   from rural areas  in search of  employment  and settled  in slums  unauthorizedly for  their  living.   The State Govt. as well as Municipal Corporation has  made  a lot  of administrative arrangements in terms of providing basic amenities like drinking water, shelter, sanitation, electricity, road connectivity,  voter ID Card, Ration  card  to them  in order to ensure  better  standard  of living.

As per Govt. record, there are  436 identified  slum settlements  in Bhubaneswar  of  which  320  ( 73% )  are unauthorized  and 116 ( 27%)  are authorized.  The total slum population is  3,01,611  with  80,665 households  , indicating  an average  household size  of 4 members.  The size of slums  ranges  from 0.045  hectares to 18.31 hectares. , the smallest  being  Radha Kristan  Basti  in Ward 45  and the  largest  being  Khandagiri  Basti  in Ward 23.  The number of  households  in the slums  also vary, from  as low as  13  HH  in Rangamatia Basti  in Ward 9  to as high as  1,414 in Tarini Nagar  Salia Sahi  in Ward 16.  The Slums listed  cover  an area of  7.15 sq. km.   which is  3.9% of the total municipal  area ( 186 sq.km.).

The Slum-dwellers  are  seen staying in very wretched  condition with very bad sanitary environment.  They are  staying  in Jhumpudi , low lying area  located  along  roadside, rail line side  and managing their  family in small hut  with  much pain, sorrow and grief.  As  they do not enjoy any right over the land,   Bhubaneswar Municipal Corporation  and BDA  displaced  and destroyed  these slums  in the name of development  or  handing over the land  to corporate  house.  It has become very common phenomena in Bhubaneswar.

As per  Odisha Govt. Land Settlement Act, 1967  and its Rules, 1983, the State Government is required  to  divide land in five categories  in urban areas making the land reserved  for   (a) Govt. offices and public purpose ,  (b) sale of land through auction, ( c)  house for middle class, (d) poor people.  (e) Small and Medium Scale Industry etc. But the state Govt.  has not yet kept the land reserved  for settlement of poor, slum dwellers in Bhubaneswar.  That’s why, a number of unauthorized Slums have been developed through out Bhubaneswar.

On the  other hand, following  the due  legal procedure of Government Grants Act, 1895 and Odisha Development Authority Act, 1981 , the  General Administration Department,  Bhubaneswar Development Authority, Odisha State Housing Board   have allotted  land  to a number of categories   of  Institutions like private educational Institutions, Hotels,  corporate house,  business institutions,  builders and Individuals like  political leaders, MLAs, MPs, Ministers, IAS, IPS officers, Govt. employees and many others.  Similarly  Many  rich, influential people, kith and kin of  the politicians  and bureaucrats  have been allotted  multiple plots under Discretionary  quota  and  through  filling of false affidavit by  the  then Minister  for  Housing and Urban Development, General Administration Department.  Many educational Institutions like Loyola School, DAV School, KIMS have been allotted land  free of premium or nominal rate. As per CAG report, Sri Achyut Samant, Founder KIIT  has  taken more than 100 acres of  Govt. land in Patia and Chandaka area through fraudulent means.  

As per Govt. record,  not  a single  slum-dweller has been allotted land  in Bhubaneswar till yet.  Since  years together,  they  have  been  demonstrating  to get a piece of land  in city   for their permanent  settlement  by way of organizing dharana and  rally  in front of assembly and submitting memorandum to  Chief Minister.  On 5th October 2016,   thousands of Slum-dwellers had organized massive rally and demonstration in front of   State secretariat demanding land patta over the land they have been staying since more than 30 years.  Around 2400 applications addressed to Chief Minister  have been submitted  to Chief Minister  for allotment of piece of land in their  favour.

 In a state-level consultation  on “Right of Slum-dwellers to access land  in Bhubaneswar”  held  on 28.10.16,  the representatives of  different political parties,  Slum-dwellers, Civil Society Groups  and Social activists  like Sri Panchanan Kanungo, former Minister, Govt. of Odisha,  had echoed  their voice in  support  of demand of Slum-Dwellers   for allotment of land  patta to them. The participants had expressed their   concern over pitiable conditions of slum-dwellers and their wretched living standard in congested slums in an era of modern development.  The meeting passed an unanimous resolution that like Ministers, MLAs and Officers, the slum people are entitled to get a piece of land for their livelihood.  Allotment of land should be made following the same procedure adopted while allotting land to the individuals, business house etc.  

It deserves  to be mentioned  that  the State Govt.  has planned to allot  house  to Slum-dwellers  under Rajiv Awas Yojana renamed  as  Pradhan Mantri Awas Yojana.  But  building under construction   are found  very congested  with small rooms and not viable  for living of  a family. Many Slum-dwellers have expressed their concern and unwillingness to stay there. 

Right to get   land and shelter is the fundamental right of every citizen of the country.  Denial to shelter is the violation of Human Rights of the Slum-Dwellers. Keeping it in view, the Central Government   has issued a Model Act  to provide  for comprehensive property rights legislation  for Slum Dwellers in the country in 2011 which has not been enacted in our state.
